UKCPS court action

Hiya, sorry to bother everyone AGAIN but i've had all the expected list of letters from UKcps after I parked in a disabled bay on a retail park for 10 mins and forgot to display my blue badge.
I've ignored all there correspondence up to now, especially as i've moved house and changed cars since then, but just received a "10day notice before court action" letter.
Please advise.................

Sadly the links on this forum to view the letters others have received doesnt seem to be working.

    Hiya, sorry to bother everyone AGAIN but i've had all the expected list of letters from UKcps after I parked in a disabled bay on a retail park for 10 mins and forgot to display my blue badge.
    I've ignored all there correspondence up to now, especially as i've moved house and changed cars since then, but just received a "10day notice before court action" letter.

  • Usual total crap. If you have ignored all previous correspondence they would fall at the first hurdle since they could not prove who the driver was. Then, the "blue badge" scheme isn't valid on private land and would be irrelevant.

    This is their last desperate throw of the dice. If you are feeling energetic sue them for harassment; if not, then just...... ignore it. I think this is probably getting to the end of the silly letter trail, once they've given you a Notice of Court action ( I bet it says "might" rather than "will") the only one left is the threat to blow up your house; after which they will go away.

    The Blue Badge Scheme does not apply in private car parks

    Read you issuer's handbook or look it-up online.

    You are perfectly entitled to park there badge or no badge - It is the Equality Act that applies here.


    Now, what else do you need to know to do with this bit of toilet paper?

    Could you help update the letters again on the top thread please? Send a pm to Crabman the thread starter, with pics of each letter.

    We used to have them but the photobucket links just lapsed I think.

    Taking someone to county court relies on part in the element of surprise, giving them little time to prepare a defence and round up documents when they are busy with other things is all part of a good plan to win the case .
    You would have to be a bit of a twit to tip off the defendant of your intentions as they would have more chance of creating a good defence.
    To be honest it would be the last thing you would do if someone genuinely owes you money.
    It is just an empty threat from a desperate crook.

    Vax, with all due respect, whilst I agree with your last sentence, the rest is not strictly true.

    County Courts take a VERY dim view of people who issue out of the blue in order to put their opponent at a disadvantage. Procedure requires a "letter before action"- an ultimatum putting the other party on notice that failure to meet a demand will be taken to Court.

    The Court system is seen as a last resort, not a first resort. If protocols are not adhered to it may not invalidate procedures, but the judge may indicate his displeasure when it comes to the question of costs.

    Hence, the Company IS going through procedure- it is just that it doesn't, in fact, have a claim it could take to Court with any prospect of success.

    They have to be careful, because anyone who brings repeated losing cases may be declared a "vexatious litigant" and disqualified from bringing further cases.

    They do all the steps to take someone to court, but forget to take that person to court as they know they will most likely lose.

    I would love this to go to court, just to see how much egg peter hasbeen can get on his face and how much he will be forced to pay out in damages when the judge rules that it's harassment under the equalities act, and for the court case to be reported in the national media with the retail park's name on it (cos that way, I can see UKCPS will be kicked out).

    I can live and dream though.
