    Hi
Received a 'ticket ' last week. in private car park, tried to ignore it as was told not legal. However was subsequently told by admin dept of offices that it stood. SO stupidly I entered my appeal letter stating circumstances for parking outside a bay (please check weather for ....) received letter stating still had to pay etc etc....I am not going to pay and have photos to prove my circumstances....Just put my mind at rest please and tell me these tickets are not legal parking tickets, I am having sleepless nights over this but WILL go to court as I know I am right.

Read the stickies at the top of this forum. They are not legal parking tickets as a private company has no power in law to issue fines or financial penalties. All they can claim for is any losses they have incurred because of your actions. If it was a free car park then their losses are ZERO.

Furthermore, if they did take you to court, they would look silly for trying to enforce their "fines" on a car park that appears to have been covered in snow.

Was this issued by UKCPS or another company? If the latter, then you would be better starting your own thread.

As this is UKCPS then be wary of what information you divulge on here, and be very wary of any private messages you receive . UKCPS are known to monitor these forums hoping to glean information from them. Don't you Peter!!

Parking bays in private car parks are advisory only, they are just pretty patterns in a car park, and you don't have to abide by them in a legal sense, though on moral standpoint you shouldn't park in places designated for disabled people. And please remove the date from the above as Peter Haswell the office tea boy for this company lurks here, and can probably work out who you are.
Excel Parking, MET Parking, Combined Parking Solutions, VP Parking Solutions, ANPR PC Ltd, & Roxburghe Debt Collectors. What do they all have in common?
They are all or have been suspended from accessing the DVLA database for gross misconduct!
Do you really need to ask what kind of people run parking companies?

What my friend Vax means, is not that you must pay regardless, but that the "appeal" system, as you have discovered, is a complete and utter sham. You could produce evidence from the Queen that you were having lunch with her in Buck Palace at the time the ticket was issue, and they would still say you had to pay.

What they want is simply to get their grubby little hands on your money- nothing else matters.

Luckily, there IS an appeal system which always produces the right result.

It consists of you deciding that you owe them NOTHING and IGNORING any more garbage they send you.

As you are willing to go to Court (I don't blame you!) I have bad news for you. UKCPS will NEVER in a MILLION YEARS take you to court. You will be disappointed, I'm afraid. They will promise you they will, and then let you down.

IF you want to have your day in Court, here's how it's done:

Send your final letter to them, stating that you absolutely deny any liability to them in the sum claimed or at all; and that their purported penalty has no foundation or basis in fact or in law.

Therefore, you will regard any further unwarranted demands for money, made with threats and menaces, as constituting unlawful harassment. (Which they are, and which they are intended to be.)

If the Company considers that they have a valid, lawful, enforceable claim, then they should proceed to lawful enforcement of it in the County Court; but that they should cease making further threats to you.

Any further correspondence of this nature will result in your seeking damages from them under Section 3 of the Protection from Harassment Act 1997. No further warning will be issued.

Send that recorded. 98% likely, you will never hear from them again as their claim against you is unlawful and entirely unenforceable- everything they tell you is untrue.

2% they will keep on going, whereupon your claim against them is entirely enforceable and you can actually see it through. And you will have a queue of people on here wanting to help you. Keep all correspondence.

Does it work? Yes it does. I did it. :)

Haswell and UKCPS must be really stupid or desperate for money if they think they can go after somebody for not parking in a bay when the ground is covered in snow.
