PCN whilst at football match

I have received a PCN from ANPR Ltd for the amount of £100. They make reference to a parking ticket placed on my car in April which has not been paid so the early bird discount of £50 had now expired. The parking ticket was never received! On the date in question my husband had borrowed my car to watch a Man Utd match and parked in a car park in Salford that he's parked in for years. He is aware that it's a private car park as there are offices on the site there but on match days there's an attendant there who takes £5.00 off everybody and allows them to park their cars there. There's about 50/60 spaces. The attendant once told my husband he has an agreement with the owner of the building to allow people to park there on match days. I wrote a letter to ANPR but they rejected my appeal and said they have no record of an attendant. They also sent photographic evidence of the ticket on the car. We have since found out that the car parking attendant is a criminal and has fled the country. We assume he was probably the person who removed the PCN ticket from the car. I imagine this is the same case for all the other cars parked there that evening. The fine has now increased to £140.00 and will obviously continue to escalate, resulting in threatening to take us to court. I need some sound advice please as I'm not sure what our chances are (based on no proof of the attendant) if it went to court. Do I sit it out and ignore any letters from now on, contact POPLA or pay before it gets out of hand?!

    Ignore it as little ole Trevor Whitehouse who owns this joke of a company don't do court (to date) , there is an option for going to popla providing that you can challenge the fake ticket. When did you get the notice to keeper? Was it within 56 days of the ticket?

    Actually as you are the registered keeper you can name the driver even if your out of time with with a challenge, they must then start from the beginning again. Naming the driver is not ideal so ensure the NtK date for you is compliant first

  • The NTK was dated 22/05 and the incident was on 08/04. I appealed in writing on 27/05 (wish I had ignored it and certainly not said my husband was driving)! Their rejection letter was dated 03/06 and by 05/06 another letter was received saying Final Demand - £140!

    Did they provide a popla verification code to appeal independently ? And they are breaching the bpa code of practice by increasing the costs so quickly

    Did they supply you with a POPLA code in their rejection letter?

  • They have given me a verification code yes. Is contacting POPLA the route I should go down now? What's our chances though based on not being able to provide evidence of the parking attendant?

    That is mitigation , popla doesn't consider appeals on that solely. You need to dismantle the whole basis of them being able to issue tickets on this land. Plus other things, like increasing the invoice that breaches the bpa code of practice
    22.12 If you reject a challenge you must:
    • tell the driver how to make an appeal to POPLA.This includes providing a template ‘notice of appeal’ form, or a link to the appropriate website for lodging an appeal
    • give the driver a reasonable amount of time to pay the charge before restarting the collection process. We recommend that you allow at least 35 days from the date you rejected the challenge.

    So take some time on this and study the code of practice
