  • I've recently hit a bit of financial difficulty and am going through the cccs for a repayment plan for my bank overdraft. I have to face the reality that my account will be terminated and overdraft sold onto a debt collector - however I'm certain that I've paid out at least 2-3k in bank charges over the past 6 years (ironically enough thats the size of my overdraft).

    Can i still reclaim the charges even though I'm in a bit of a sensitive position here with the bank?

    hi,if you have paid bank charges,you can reclaim them,just because your overdrawn dosent make them any more lawful,get um all back lol.good luck,oh need any help,just ask

    Yes you can reclaim them but be prepared for the fact that the bank has the right to offset any reclaimed charges against money you owe them, meaning, the money will probably go straight towards clearing your debt, not to you to do what you please with it.

  • Since requesting my back dated statements from HALIFAX, my account has been closed due to the fact that i only have an EASYCASH account with no overdraft facilities etc and my account has been approx £90 overdrawn for some time. Will it effect me reclaiming my charges as my account no longer exists due to an unauothorised overdraft. Understandably-if i were to suceed in reclaiming what is rightfully mine then i would gladly re-pay the outstanding debt.

    Hi I'm new to all this so help would be appreciated. Mine is the usual story, charges on top of charges on the Abbey current account spiralled out of control. The account was closed with an outstanding overdraft amount and it was passed to some third party company to reclaim the money from me. I've written to Abbey to ask for my money back and am waiting for their response - what do you think the chances are seeing as it's with a debt company now?

    Oh you can still claim you are still more than entitled to, but any monies owed to them they are entitled to claim back. They will ofset any money claimed against any outstanding debt/overdraft.

    You can claim but not from the third party!

    Your claim is against the bank. :) I was in the same situation with I.F. and IKEA! And I still owe money against Marbles Card but it was converted to HSBC Interest Free Loan account. Marbles paid out without paying it towards the Loan! ;)
