    I claimed against Marbles, I.F., Capital One, and IKEA. All of these accounts had been closed and passed on to DCAs apart from Marbles who turned it into an interest free loan with their parent bank (HFC) and I'm still paying it off although its the only one I'm still paying as I've cleared off all the rest.

    Anyway, all the claims were made against the original Banks/CCards and all paid out via cheque direct to me. So thats a 100% success in claims :) Best way to maximise your claim is to go via the courts and get interest added at 8% which is far less than they charge but over a longer period so could get up to 48% if over the full 6 years ;) Its always best to maximise your claim especially if its going towards paying off your debts because the more you claim today the less you owe tomorrow :)

    Hi

    I had an account with HSBC but it was passed onto a debt collector (dlc) and the account was closed. My question is, can I reclaim the charges from HSBC even though the account is no longer open or is it hopeless?

    Yes you can claim on a closed acc. Just use the same procedure. If you don't have the acc. no. the bank can get your details for you through name, address, date of birth etc.

  • Help I am with the Abbey who have closed our joint account down due to being overdrawn through their charges. We are going through the process of claiming them back but in the meantime they are still charging interest and have passed on the debt to a bailiff company who are sending us threatening letters about bailiffs coming in. What can I do (i have now opened an umbrella account) - I know that once we get our charges back then we won't owe them any money but why are they still charging us interest when they have closed the account?

    It's not clear from what you say but don't forget that (1) bailiffs cannot claim any property without getting a court order and (2) you do not have to let them in and can hide property BEFORE THEY ENTER so they can't take it. Contact the national debtline (0808 808 4000) for thier really good fact sheet about this!

    A little help would be appreciated!!

    I am in the process of trying to claim back nearly £2000 from Barclays however the debt on the account was " sold " to a collection agency to which I settle the account in full. Can I still claim my charges back from Barclays even thouhg the debt was transferred?

    Any help would be really appreciated !

    hiya yes you can still claim because you no longer owe barclays anything... you owe(d) the collection agency...
    as it goes back 6 years you could be in for a windfall
    go for it .. you have nothing to lose and everything to gain.think of it this way... i bet if it wasnt for their charges..your account wouldnt have ended up with a debt on the account in the first place!
    go get em!
    and best of british!!

    thats your money they had and its time to go get it back!

    Ive been looking under previous posts under collection agencies etc.... and thinking back on it I settled the acocunt with them in January with a one off payment for a reduced amount so... I could even get back more than I actually paid - but will still have to request the statements to check what i can claim!! Not sure if i can caim back accrued interest on the debt - do you know ??
  • I have recieved a letter from HSBC agreeing to pay £1270 of a £1780 (amount plus interest) claim I made. I am happy to take this amount but I have a loan with them that has been passed onto a debt recovery agency to which I pay a monthy amount. They are saying that the £1270 will be deducted from the loan repayment amount, does anybody know whether I can get this money without it being deducted. I no longer have an account with HSBC and would prefer to keep paying the monthly repayment as it is ???

    I've had a court date for first direct set for months and its coming up on 3rd august. Low and behold, i get a letter today from their solicitor offering full payment including interest and court fees, but stating that it has to be paid to the debt which is not being dealt with by a debt collection complany. They've stated:

    "In view of your ongoing indebtedness to our client, which has been referred to a debt collector, any adjustment made under the terms of this letter will be paid to the debt collector in reduction of your debt and in exercise of our client's legal right of set off, except in respect of any court fee you have paid which will be refunded to you by cheque."

    Is this correct as my understanding was, they could only make you pay off the balance if you had missed a payment and were behind, which i am not and never have been since the debt was moved to the DMC.

  • THe fact that the amount of your debt is being reduced should be a good thing. THe likelyhood is that an account is still open in your name to accept credits only until the balance clears the loan. How much is left on the loan?
