  • Help I am with the Abbey who have closed our joint account down due to being overdrawn through their charges. We are going through the process of claiming them back but in the meantime they are still charging interest and have passed on the debt to a bailiff company who are sending us threatening letters about bailiffs coming in. What can I do (i have now opened an umbrella account) - I know that once we get our charges back then we won't owe them any money but why are they still charging us interest when they have closed the account?

    As far as I am aware once a debt has been passed to debt recovery then they have to stop charging interest. I would be on the phone to them querying this.

    Please be gentle, this is my very first post and I,m very scared of what may happen.

    I'm just starting out to try and reclaim charges from Natwest.
    My debt was passed on to a collection agency (Intrum Justitia)
    I have been paying them for quite a while now.
    I presume I go for the bank for repayment of charges, but what about the people collecting the debt for the bank and the repayments I have made to them.
    I got into a mess and the bank just kept piling it on originally, making it impossible to catch up.
    Please advise my best approach.

    Recently both myself and my wife began the process of recaliming bank charged from Capital One.

    Both of our accounts accrued defaults some three years ago and both accounts are held with DCA's.

    My wife received a letter saying the derisory offer would be made direct to the company who have bought the debt.

    My letter says i will not get a penny due to the default.

    Does anyone know if this is legal/lawful ?

    Any help would be gratefully appreciated.

    been in a similar position and actually made my first post about 10 mins ago on here!
    I had defaults with four credit card companies and a bank. Although all settled (75% repayment except a natwest loan that i got to 50%) i now want to reclaim the charges too.

    I'd guess (and that's all it is) that the bank got the charges, so they are still liable to pay them back. Lets both hope so anyway.

    I'll let you know if i find out any more myself

  • When you talk about the 75% and 50% settlements do you mean to settle the accounts in full?

    I dont see how an account holder should be disriminated against if the account defaulted, cap one told my wife that any refund would be paid direct to the DCA, although the DCA was not overcharged in the first instance my wife was!

    We can both clear our cards if we get our refunds and the DCA's settle at around 75%.

  • Hi, i am at the moment in the process of taking HSBC to court to reclaim bank charges, my account was closed last year when i fell into financial problems and i owe them money which is basically paid through a debt collection agency, if i win my case can they just take the amount of what i owe them or can i get the money as a cheque for example. Can anyone help please, thanks Mike.

    I have to say if you owe any money then they will take that back befor they give you what is left.Hope this helps

    I have an old account that was overdrawn (mostly charges) and was closed with the overdraft still outstanding. The bank sold the debt to another company, with whom I have a payment plan set up. The balance on my original account is therefore zero. I have sent in a claim for my charges and wondered if anyone has an idea how successful this will be. Also, will they pay by cheque, as the account is closed?

    I dont see any problems, even though the account has been sold on the charges were while you were with the original company. Not sure what they will do with it if you win, Im guessing they would send a cheque as they sold the debt on.
