    Hiya, can you claim your charges back on credit cards that have been sold to a debt buyer?
    I have a £953 debt with monument, they've recently sold it to cabot. I know i have a fair few charges with monument, that i'd like to try and claim back.
    So can I?
    And if I can, do I send the £10 and request to monument or cabot?

    Thanks.
    Sorry, I'm new to all this, totally confuzzled!!!

    YES :)

    Your claim is against the Credit Card. I have done it with Marbles card, I.F. and IKEA ;)

    Still paying off Marbles ;) but payment was made to me :D
    Got It & Spent It :dance:
    IKEA CARD = £120 charges = £175 received (146%)
    MARBLES = £450 charges = £370 received (82%)
    I.F. = £494 charges = £494 received (100%)
    CAPITAL ONE = £981 charges = £1,489.03 (152%)
    BARCLAYCARD = £580 charges = £786.12 (136%)
    On Hold :mad:
    A+L = £722 charges (target = 147%)
    BARCLAYS = £1,405 charges (target = 128%)
    BARCLAYS = £175 charges (target = 140%)
    ABBEY = £3,220 charges (target = 148%)

    You can only claim your charges back. All the other amounts sound like debts and not charges.

    So, do I send the request to the original creditor?
    Thanks for the reply.

    You send the letters to the bank/cc you are claiming from but as you can see from the above posts be aware any monies reclaimed are likely to go towards any debt held by the bank or passed to a DCA.
  • I had an account with Abbey which was closed about 6 years ago due to being overdrawn from £494 of charges!
    I have moved house twice since the account was closed and haven't made any payments against the debt or recieved any letters from Abbey in this time.
    I thought that I would request my statements from Abbey and try reclaiming the charges, but what do I get in return? They have sold my debt to a debt collection agency who have now written to us demanding full payment!!

    I'm going to grit my teeth and carry on with the letters asking for my statements and write to the debt collection agency telling them what I am doing!
    Cheeky beggars!!!

    Under the Statute of Limitations Act 1980 you can only claim back 6 years from now.

    On the other hand, if/when the debt is over 6 years old, they can't chase you for it either.
    The acquisition of wealth is no longer the driving force in my life. :)

    Ok so I have paid my bank charges via a debt collection firm who wrote to me after I moved house leaving a debit balance on a current account.
    I know it was wrong to try to skip out, head in sand at the time hence me coming here attempting to be a money saving expert !!
    Do I stand a chance getting the charges back seeing how the Bank presumably sold the debt to the firm in question? Any help would be SOOOO gratefully received!

    As the above posts, you can put in a claim but any monies reclaimed will go towards the debt held by the bank or a DCA.
