OK.....Lloyds TSB closed my account due to having gone over my authorised overdraft and passed my account to their collections department.
As my account was overdrawn due to illegal bank charges....does this mean thats their attempt in collecting these funds are also illegal ?
I only ask as they have now passed the account onto their solicitors who wish to recover the outstanding balance.
Can they claim for illegal charges against me ?????? or can I request they close the claim for the outstanding amount as they are claiming for illegal charges againt my account.

hello i was just wondering if any one can tell me if im still entitled to claim back chages even though my bank account was closed with me owing them £1300 for a over draft,which spireled out of control through getting banks charges which i didnt have the money to pay back in to the account to get back on track.the account has been passed on to a dept consilidation company so the bank is still getting paid back jus in a smaller amount then i was paying0

Yes, you can claim back charges even though it's with a DCA and even though it's "closed" with the bank. Follow the normal steps. I'm claiming back £1500 from the Bank of Scotland for two accounts that were passed on to Blair Oliver and Scott. What they might do is use the money claimed to pay off the charges but I look at that as one less debt to contend with!"Think for yourselves and allow others the privilege to do so too." Voltaire.0 -
I had an Abbey Bank account and because they went completely bonkers by charging me so much for 'being over my overdraft' and bounced DD and SO, I went well over my overdraft and could not repay it. They eventually put a stop on my account and then closed it. It went to their debt department and it was agreed that I would pay them a monthly amount until the over £2000 is cleared but that is going to take years. Does anyone know if I can still claim back my bank charges even if things have gone this far?0

Yes of course you can. A lot of people are claiming on closed accounts (saves you the worry whether they are going to close it down as a result!) You can claim up to 6 years back. Follow the steps in Martin's article.Reclaimed thanks to this site:

You can claim but as the bank has closed your account they will more than likely want any claim paid into the account to clear some of your debt with them.0

I hope I am doing this right but I just wanted to thank the people that replied to my query. I have in fact found over £1500 worth or charges which means that it would reduce what I owe down to £500, what a result!! Fingers crossed it works :j0

I live in Scotland. Over the last few years i have paid hundreds of pounds in bank charges. In May of last year i took out a Scottish trust deed because i was at my wits end trying to make ends meet.The Bank of Scotland closed my accounts and subsequently sold on the debts. Can i still claim back my bank charges?0
