Hi,
I have started the process of reclaiming Bank charges, but is it the same for Credit cards? I have seen a template letter that talks about how the account has been kept in good order, except ours hasn't as all our debts are with Payplan.
Can we claim credit card charges in the same way, even though we are now with a debt agency?
Also can all our Creditors decide not to play ball with Payplan anymore, and demand all their money back? Im worried about this, as it has been hard enough to get them to accept payplan in the first place.

I lost a few posts from this thread since 2/2/07 to 16/02/07 maybe later and had changed the thread title to read something like Bank closed your account and with a DCA. If your posts had been in this thread, I'm sorry but they have gone to the Bermuda Triangle in the sky

This may have been answered before, but I can't find it in any threads.
At present we are still being charged the late payment, overlimit charges etc on most of the debts we owe.
So do I wait until all of these have been sold on to DCA's and all these extra charges have stopped before reclaiming the charges or start the process now?0 -
Hi there I am no expert but Martin was saying there will be a ruling in April setting limits for charges e.g. bounced cheque £12, he thinks that we should go now after any charges because otherwise the judge may get the bank to pay bank the differenece. e.g. They Charge you £30 the new rules say £12 so you get back £18, whereas if you go now you will get the £30 back. Phone your court and get an N! form and get your cases listed as soon as possible is my advice.

Can anone tell me why companies in Scotland who pass defaulted accounts to solicitors use firms that have the same Initials as the Company concerned? For Example - Blair, Oliver & Scott = BOS = Bank of Scotland, Smith, Lawson and Company = SLC = Student Loan Company..... I could go on.
Is it just me, or has anyone else noticed this?

Sorry if asked before or detailed elsewhere, but can I re-claim bank charges against a bank I am no longer with and who I have a repayment plan with for my debts to them via a debt collection agency such as cabot financial? (The majority of my debt was because of bank charges)

quick answer is yes you can but the bank will probably make refund to the debt collection company directly and not to you. It will reduce the balance though and if you having difficulty you may be able to negotiate a smaller repayment schedule based on the obvious reduction in time needed to pay over. Repayments are sometimes calculated on repayment within a certain time period and dont necessarily reflect your whether you will comfortable paying the set amount.

I need advice on if we can claim the bank charges for my partner...
Basically what happened was, he was late paying something at his bank, due to the loss of his job. As most men like to do - he buried his head in the sand and hoped it would all go away! But it didn't! it got worse!
This then escalated and he was charged every day until the amount we then owed was approx £1400.00. Now we are paying them back at £30 a week, but to a debt collection agency.
Because the account has been closed and passed on to a debt collection agency does this mean we can't fight it?
The worst thing about all this is that we are paying back over one thousand pounds that we haven't had!!

my old bank account (now one of my creditors) hsbc is still charging me for been overdrawn :mad:
i noticed 150 quid over drawn charge when i checked my account online.
i am just about to reclaim my charges from them, have i still got time?
and can they still charge me? cos the account is closed.
