You can claim but be aware any monies reclaimed will be paid towards the account that is in debt which will of course be to the good in sorting out that particular debt.0

yeah katie dont worry ,these idiots are just playing with you..i had halifax trying to stall me all the time just remind them that under the goods and supplies act 1982 they are lawfully bound to send statemenys to you and if they do not comply within 7 days you will report them to the oft and fsa etc..just get aggressive with them without swearing..also bombard them with emails..it will work trust me...0 -

long story short my bank kept making these stupid charges against me for sums like a £35 charge fo being 9pence overdrawn. Anyway with these ridiculess charges my debt finally reached about £700. I took a stance and as a result my account was then passed on too moorcroft debt agency. I have since paid them just over £400 pounds. Much more than the amount i ever went overdrawn with. SO my quiery is;
Does anyone have any advice as too how i would get the bank and debt company to quash the remainder of the fee. Iv tried the reclaim route and still am but what with the latest news on it all id rather just accept my losses, quash the other £300 and get on with a debt free life for once! Im refusing to pay anymore!

I need your help please. I was made an offer for £2250 six weeks ago which i accepted. As of yet i still have not recieved the cheque. I have phoned the FSO but they have just said to wait as Abbey are running behind with everything. I keep phoneing them but they just keep giving me the run around, but was told today that they are waiting for an email from the debt recovery and collections team. This is what has got the alarm bells ringing in my head.
My question is that because my bank account went so far overdrawn they closed my account and gave it to a debt collection agency. I pay the debt collectors monthly but still owe a few thousand.
Will the bank send them the cheque or will they send it to me?0 -
I have read what i wrote and it now dont seem to make sense.
I owed the bank £6000 of which £3000 was my overdraft and the other £3000 as charges. Because i could not pay the £3000 charges to get it back into my agreed overdraft they closed my account and passed the debt to a debt collection agency.
After finding this site I made a claim against them and to cut a long story short they made me an offer of which i accepted. But what i need to know is weather they will send me the cheque in the post or weather they will send the money to the debt collection people. Has this happened to anybody else?0 -

The bank will quite rightly offset the refund against the money you owe them. Why shouldn't they?British Ex-pat in British Columbia!0 -

I did everything i was told to do from this site, by sending letters to nationwide asking for my money back for un-necessary bank charges etc. Same from Nationwide 3 basic letters saying thank you but we are in the right etc.
Then in Sept we got a letter from Nationwide confirming they had reviewed our complaint and that this had now been stored until the outcome of Office of Fair Trading, and that once the legal proceeding between the OFT and the banks finsh they will then resolve our complaint ASAP.
They stated in the letter if we wish to apply to the courts to issue a claim against them the would apply for a STAY until resolution of the proceeding with the OFT.
Last Week i came home to a letter from Commercial Collection services asking for the o/s balance on our flexaccount of £381.60 ( which are charges along with more that we are claiming- note flex account was defaulted in May this year) to be paid by 11.00am on 11/10/07 otherwise they would issue proceedings against us.
How can they do this when Nationwide have stored our complaint- should i issue proceedings today against nationwide before they get a chance to do to us, has i don't really want this on our credit file with selling our house and looking at the mortgages.
Please could someone give me some advice

Hello, I am sorry if this has been asked a thousand times, I did have a quick look but couldn't see anything regarding this.
I would like to reclaim my credit card charges but......
I am currently in arrears with both Capital One and Barclaycard.
My credit limit with Barclaycard was only £200 but I missed a payment one month and then they added a charge and it has spiralled because I chose to ignore it as I didn't have any money at the time.
Now my balance with them is something stupid like £800 and I have been getting lots of debt collector letters and such.
Now as you can see most of the £800 is all charges added and added on which I am not going to pay without a fight.
I was just wondering seeing as they said they have passed my debt on and I am currently in arrears can I still make a claim against them???
It's the same basically with the CapOne card.
Apologies again if its been asked and answered before.
