No they were'nt clear. They do have some outstanding on them when cap 1 sold them to a 3rd party collection agency.
Do you think they would have paid off the balance left on those?0 -
I believe the banks have the right of offset if you still owe them money. Don't think it matters if the account has been closed, they will re-open it to pay themselves back.0

How strange that they allowed you to keep one card, when you owe them for another two. Thats unusual.
If there is now credit on the 2 closed cards, ask them to transfer it to the open account, or send you cheques for the balance.
Natwest opened my closed bank account to refund me. I went and withdrew the lot, and asked them to re-close the account. They didn't, and started deducting account fees of £12 a month, taking the account overdrawn. This resulted in a default, which i am now fighting.
So make sure the accounts are re-closed when you have done, as they may appear back on your credit report.0 -
Look on the bright side, they should remove the black mark from your record, so long as it has paid back all the money you owed them
I rang the court yesterday and judgement has been entered in my favour, so they cannot defend. But I need to call Cap 1 tonight to check that if they've kept the money that in fact they have cleared the cards.0 -
at present i am paying back a debt recovery agency regarding my Littlewoods account, I am paying £30 a month, in 2 months time I will have paid back everything that I have bought off them, but a balance of £128 will remain, this is the total of all charges.
I will not be paying that, but each month I dont pay they will add £12 to my account.
As they have not got the money from me, how would I go about appealing this, since they owe me nothing but believe I owe them £128.0 -
You need to actually put in a claim for the charges then any monies reclaimed will be put towards the debt on your account.
mouse dust, I'm not sure what a CCA is but yes, sounds a good plan0 -
My account was passed over to a debt collection agency and I am no longer paying interest/charges. Can I claim back charges that occurred before the account was passed over to the debt collection agency and over more than 6 years?
Has anyone had to do this?

You can not reclaim if over 6 years ago. Up to 6 years is fine, regardless of whether the debt was passed to collectors. Write the standard letter available on this forum to the branch of the bank that originally held your account.Don't lie, thieve, cheat or steal. The Government do not like the competition.

I'm sorry, I don't apologise. That's just the way I am. Homer (Simpson)0 -
Is there any point to claiming then if over 6 years and account with debt collector? Bank will be quick enough to say your time is up we dont owe you anything!0
-
Is the 6 years from the close of account or from the time the account went over to a debt collector?
