  • I was wondering if anyone would be able to help me. Here's my situation.

    I am a student, and about a year and a half ago charges on my RBOS student account spiralled out of control. I was terrified and ignored it, which I know to be a bad idea. However, it eventually caught up with me and my account had been closed. I have since entered into a payment agreement with their debt agency and have begun to pay back my £1450 student overdraft and the £300+ charges I incurred on it. My question is, can I apply for my charges back even though my account was closed and I entered into a payment agreement (I was given no choice about either of these situations)? And, does this mean I have a default on my credit file?

    Also, can an electricity or mobile phone company affect my credit rating? Around the same time as the charges my flatmates began missing payments for our electricity bill, which was in my name and I also missed several payments of the mobile contract I had at the time. Would this mean defaults on my file also?

    Also, I can't get a new student account - is there any available that will be more lenient with poor credit.
  • If the debt you owe has been sold on to a debt recovery company, are you still entitled to claim back any charges or fines?

    Yes you can.

    You can still claim against a closed account. Any account live or closed within the last 6 years. Although you can go back earlier than 6 years, not sure ofthe rules and regs etc

    However, any monies reclaimed is likely to be paid towards any debt.
  • Can anybody help?!

    I have a bank account which was sent to a debt collection agency back in 1998 when i was a student! I would like to claim back all the charges which forced it there in the first place, is this possible?! I called up the agency who take payments for it every month and they assured me that Barclays Bank still own the account and the debt hadnt been sold to them, would the 6 year window apply from the time that they sent it to this agency, in 1998?

    Any advice gratefully appreciated

    Sorry the sums don't add up.

    You always have the option of arguing that the bank doesn't have the protection of the Limitations Act by the fact they've concealed the true costs of charges.
    Hamsters have no tact and diplomacy, nor do they want any.

    You can but they can also pay them towards the debt.
    They took my signature away!!!! :confused:
