    Hi!

    My hsbc outstanding debts have gone to a collection agency, but i am still claiming from hsbc.

    Go for it!

    Thats interesting, my HSBC account was closed and passed to a debt collection agency. I was shocked to find that I had almost 5 grand in charges. I have started the fight with the initial letter but I have been a bit scared to carry it through as you dont read about many people claiming from a bank that closed the account and passed debt to a collection agency.

    Hi Gary if they are saying take us to court, then do so.

    What they hope is that you will not bother, so they win or you will start proceedings and then not bother - they win again, they hope that they can intimidate you and hope that you will lose sight of the goal and settle for a smaller amount - please dont to both.

    You will get a huge amount of support from this website, and I am happy to be your 'buddy' and talk you through how to do it if you want. I successfully claimed 850.00 back from Abbey last year, and I am helping my partner do his.

  • I am also in the same situation. Barclays closed my account as I had an outstanding overdraft of £1800. I am in contact with the collection company now and intend to pay this off todya, but do you think I would be better off not paying until I have tried to claim the charges back with the bank, or pay off the debt in full and then try and claim the charges?

    Any advice would be really helpful.

  • :T hi i made a claim to natwest for my bank charges for £2166.10 and they replied and made me a offewr of the amount i requested and they put the money in my account which they haven t closed they sent me a letter of a apologies the other day saying they was very sad to see i was nt happy with there charges. so i think i did ok with the


    i,m now claiming from the royal bank of scotland who has kept putting my charges to the loans and now are closing the account and put it in the hands of a debt collector which i,m not sure which way this one will go ill have to wait and see if anyone has any advice for me regaurds these could you please let me no

    With regard to paying money on the loan you can offer the DCA a payment per month based on your incomings and outgoings. Carry on reclaiming the charges in the meantime though, dont be put off. Good luck :)

    whilst i was a student i was unfortunate enough to get myself into debt with barclays, this obviously meant i paid loads in charges, upon finishing university i got, but ultimatley lost my job meaning i couldnt pay back what i owed and they closed my account and chased me for the money before selling it to a debt recovery agency.

    I have since dispossed all of my old account details, as this all happened within the last 6 years i wondered if it is possible to recover my account details and therefore claim back some of the charges??

    your help would be very much appreciated!

    You can sstart a claim but be aware any monies reclaimed are likely to go towards any debt be it with the bank or a DCA. Using the template letter you can ask for all information and/or your statements by sending in your name, any relevant addresses and your date of birth to the bank concerned and they should be able to trace your account.

    RE: account in the name of XXXXXXXXXX

    I am writing to request a fully comprehensive list of all the default charges for direct debit, unauthorised overdrafts and standing orders I have paid over the last six years.

    Unfortunately Due to me losing my job and being unable to pay into my account for some time you chose to close it and sell the debt from my outstanding overdraft to a debt recovery agency. The only details I have are my personal details which I have listed below.

    Name
    Address
    Date of birth

    The account I had at the time of closure was I believe a graduate account as I had not long finished university. I have been told that this information I have given you should be enough to enable you to forward me the information I require. Should you require any more of my personal information please do not hesitate to contact me.

    I have enclosed a cheque for the maximum statutory charge of £10. If you are unable to provide this data, I will accept a copy of my statements going back six years; I understand that statements on their own are not covered by the Data Protection Act 1998, yet I’m not requesting the statements per se, but the charges, which I’m entitled to by law.

    If you store any of the older records on microfiche, please be aware that the Information Commissioner deems this to be a relevant filing system under the Act. As such, any microfiche data must be sent to me in fully legible and comprehensible form.

    I look forward to your response within 40 days, as Barclays Bank is obliged to reply under the Data Protection Act. If not I shall seek remedy from the Information Commissioner.
