    HI Gary

    You must claim against the bank that levied the charges in the first place.

    If you tell the debt collecters there is now a dispute, they may give you some time, but you need to act on it fast, and reclaim from the banks.

    They may say they can do nothing as its now with the debt collection department, but thats not the case, they will say anything on the phone to fobb you off.

    Sarah, thanks very much for replying so quickly. I am very excited by this turn of events. Only found out about it today (yes head up bottom i suppose) im actually really good with money now, i have to be ;o)

    What i dont understand is once they have set a precedent and paid out one claim surely they have no case for turning others down??

    They are yet to do it in court yet. They always refund as "a gesture of good faith" and "without prejudice". Thats why they never go to court as they will be forced to tell the world what delinquent accounts acctually cost to run.

    Ah! so from what i have read it seems all the banks are saying "Take Us to COurt" what do i do then? Sorry if you are repeating yourself... Cheers.
  • Hi I am very new to this, I have asked the Abbey Bank for my bank statements (and sent them £10.00) and have received a letter back (pre written and looks like a photo copy) saying that the Abbey have sold my debt to a financial company (the debt is 3-4 years old) so are unable to help and I have to call the financial company, do you think this is right, Abbey have kept the £10.00 I sent them, I believe that over 70% of the debt (£2500.00) is bank charges of all sorts and would like to clear this debt up.

    So what do you people out there think my next move should be ??

    Sorry to hear that you have had a few problems.Surely they should still have some statements on record for you.In anycase the £10 you paid for them should have been returned immediately they could not complete the service.
    You will need to start writing to their customer services dept as a letter of complaint.They will then reply with their version and include a leaflet for you to complain to the FSO if you are not satisfied.I would also write to the other
    company who took over the debts.They may want to sell it back to them.This recently happened to me when Lloyds sold on a debt in my name(not mine though),and had to refund the buying debt agents.
    You may also want to involve http://www.csa-uk.com/
    They were recently on the BBC'S Watchdog programme to assist consumers.They may offer you guidance.
    Good luck it's going to be messy.Don't think the ride will be smooth.

    They will have sold the debt just as a monetary figure to reclaim, not all the information that goes with it.

    They have to keep a statutory minimum of six years worth of records for you by law so they will still have statement information.

    In any case, as the above said if they couldn't supply the statements why did they keep the £10?? Sounds like someone got a bit muddled to me.

    Try calling customer services (or there should be a number on the letter) just to see if there has been a mix up. Otherwise if you have no luck, write again refering to your first letter and the fact they have kept your £10 fee so must now produce the items you were requesting. Also let them know that irrespective of forwarding the debt to a debt collection agency you are aware they should still have retained statement information going back six years by law.

    Otherwise, a complaint to the financial ombudsman.
  • I have read it is possible to claim back from both catalogues and also credit cards, however due to my bad money management at the time both my credit card and catalogue went to a debt collecting company would i still be able to claim even though this has happened?
