Just hoping for some advice and info on this issue which i cant seem to find !
Im in the process of claiming charges from two banks for current accounts which is all fine and simple
Im also thinking about trying for all other charges on credit cards etc ive paid in the last six years also.....
However.....
On all of these credit cards and some others I Defaulted about 3 years ago and the accounts eventually got closed with the Debt going to debt collection agencies...Some i have still not managed to settle
Am i able to go after my original creditor for these charges and get them to pay me by Cheque without just debt to these collection agencies being reduced ?
I may of course use any money i get back for charges to pay off some debt to collection agencies but the ideal sceneario would be for a full Cheque refund from the orignal creditor and then to negitiate full and final settlement of a partial amount with the debt collection agency?
Just wondering what the situation is here when you are going for charges agaisnt people who you have debt with that has been defaulted and sold on/handed over to collection agency?
Actually in addition to that what is the situation for going after charges when you already have a debt with someone ? Can you get them to send a cheque rather than just reducing your debt with them ?
Any info and help please on this issue as i cant find anything anywhere

Does anyone know if you can reclaim charges that were applied to an account which is now closed? About 7 years ago i got ill and into financial difficulties which ended up in Natwest closing my account a few years later. In the time i was ill I had loads of charges and interest added, eventually I got into such a state they put my account to a debt company who I am still stuggling to pay off (Natwest did know about my illness and didn't offer any help or advice).
Would love to get some money back but don't know if it is possible can anyone help?0 -

I am asking the same question myself about closed accounts.
I know very little so I am sure someone will correct me if I am wrong but as far as I know you can only claim back 6 years!

Hi.
I have / had a business account that I stopped using in January 2006. The acccount was overdrawn by £45. From February 2006 to February 2007 I was caring for a relative with an illness. I explained this to HSBC, and the fact that I hadn't done a single transaction with the account over the 12 months, yet they still managed to hike the charges up to an incredible £485 !
I had a meeting with the bank manager to try to sort the problem yet she told me that the matter was now out of HSBC's hands and my account had been formally closed - although I had no written conformation of this !
Because I refused to pay the ongoing charges, they have now referred the amount to a debt collection agency. I have set up a 6 month plan to pay the amount off.
But my question is - can I still claim the charges back before the 6 months period is up for the repayment scheme or can I not claim back money that hasn't been paid?
I'm not going to rant about HSBC's policies or charges as it seems all banks are the same. They seem to forget that we are people just like them.
Any advice would be appreciated as I would like to be assured that I will be able to claim MY money back in the future.

The stress these people cause is unbelievable and I urge you to stop worrying Right Now, stress kills.
Write to the debt collection agency, recorded delivery (costs £1) , informing them the account is in dispute regarding unlawful bank charges. Then get reclaiming following the template letters and timsecales. You can reclaim from both accounts good luck
Totally agree with your post! Wondering now that if due to the banks etc unlawful charges plunging people into further debt and stress and incurring ccjs after ccjs whether the ccj incurred is also unlawful and be overturned? Surely has a snowball effect. Debt stressing me out too im currently paying a debt management company per month to distribute monies between my creditors, and still they threaten me with court action tut tut! shoot me now i say! just wish i had a huge lotto win to regain a semi stress free life for once!:T This site is great! Yes you can still reclaim. Your bank is the one to ask for the 6 years details and to reclaim from. Good luck0 -

It is any debt on which unfair charges have been imposed, however, bear in mind that debts owed by incorporated companies (which you may have guaranteed?) are probably not covered by the CCA Regulations. You will need to reply on common law in your claims if that is the case. The DPA does not apply to companies either, as far as accessing data goes. Finally the banks/CC companies may decide to forward any refunds to the new owner of the debt. Bear that in mind too.0

Ok,
I was useless with money and for that reason i was charged huge amounts of charges on all my bank accounts and credit cards. Im not proud of this. I have massive debt and this looks like a glimmer of hope to get some of this back. I reckon over 6 years from 11 bank/credit card accounts i was probably charged in excess of £20,000 in charges! again im not proud of this!
My question is, If my accounts have been passed over to a 3rd party debt collectors etc am i still able to claim these charges back via the actual Bank itself??
Any advice would be very useful and i thank you in advance....0
