It's when you started living together as husband and wife that counts. If you are now entering a relationship and living together as a couple, now is the time for your partner to come off benefits. Occassional sexual relations does not amount to benefit fraud - unless, of course, you were in a relationship.

Your new partner simply signs off the benefits he is no longer entitled to. I have a lodger who is on benefit and occasionally we have had sex, however over time we have gradually fallen for each other and now want to declare our relationship. As a higher rate tax payer I know that he will not be entitled to benefit anymore.
What we want to know,is that when we declare our relationship will we be accused of being in a relationship previously (we have been living together for a year) and hence have been committing benefit ? How do we prove we wern't previously in a relationship ?
You cannot prove that you weren't and they cannot prove that you were. I very much doubt that any such question would be asked.

In a previous post back in January you referred to you and the other person as 'we' not 'me and my lodger' which could be taken as indicating you were a couple then.
The fact remains that if everyone claimed successfully for the nights they didn't have sex but not for the ones they did, the country would be bankrupt.

I don't think it's quite as difficult as you're worrying it will be, you declare you are no longer "lodger and landlord" from the date you consider your relationship to have officially started. Usually when we look at it, we are looking for the date you started sharing the same bed at night and and started thinking of it as "Our bed", and your partner stopped considering the other bed "My bed".
In the case of two singles who now wish to claim as a couple, the date of the first um "bedding" is not the date of the relationship start, you are not a couple in the eyes of the law just because you have had sexual intercourse. Declare to them the date from which you now wish to be considered a couple and they will use that date, try to use the date as close to the date you guys considered yourselves a couple so you know you've told the truth."There is no substitute for time."
