    Really?

    So you can accept the first amount they offer and then pursue the rest? Even if their offer letter says the inital amount is offered in final settlement?

    OK. So I claimed back the fig in my sig from MBNA. They wrote back telling me they would consider my claim and come back to my by the 19th Nov - tomorrow.

    So far - nothing.

    If I give them until morning of 20th to allow for post, the next stage is the template letter basically saying that as I have not heard I will proceed with the ombudsman/court.

    Is that correct?
  • I've sent out letters for my mum re: her credit cards, and MBNA have offered her around £600, saying they will send out the cheques shortly.
    What I want to say is that while she is willing to accept them as a part payment without prejudice, she doesn't consider the matter closed and intends to pursue the full amount.
    Is that sufficient to ensure we can still continue and pursue the balance?

    And also, if they still send out the cheques, by banking them, is she actually accepting their offer?
    So in other words, should she wait until they acknowledge the next letter, stating they are only accepted as a part payment, before she puts them in the bank?
  • This is how I've written the letter, if it helps

    I refer to default charges applied to my account amounting to £1,723.30, which I have requested you pay back.
    I wrote to you on 8th October 2008, making the original request for a payment in settlement of my claim. I have recently received two letters from you, one offering me £315.00 in full settlement of the claim on account number XXXX XXXX XXXX XXXX and the other offering me £269.00 in full settlement of the claim on account number XXXX XXXX XXXX XXXX,both as gestures of “goodwill”.

    While I am willing to accept these amounts as a part-settlement without prejudice, I am writing to inform I intend to pursue the remaining balance of the full amount claimed together with interest up to the date of judgment and court fees in the proceedings through the county court
  • I am about to start an assault on MBNA, GE Capital and possibly Capital One to reclaim charges from my cards. BUT.. I have read one or two other posts saying that once they reclaimed their charges MBNA closed their account. What are the chances of this happening and if they close the account will they expect payment of the full outstanding balance? We have around 5k outstanding but the card was withdrawn so we wouldn't miss it but we would have no chance of coming up with that kind of money and are unlikely to be able to get another card to transfer to at the moment. Does anybody have any experience of this? I don't want to start down this road and end up worse off (if that's possible)!

    I would decline completely the offer and state that you would only be willing to accept 100% back.

    I'm going away in a couple of days for almost 2 weeks and need to make fast decision re getting a letter out asap so any advice you can give would be gratefully received!

    MBNA - I've claimed for the amount in my sig (charges plus interest).

    They've just replied with their standard letter basically saying:

    "We don't agree we're at fault, but here's (a poxy) £175 as a goodwill gesture. Cheque will be in the post in 10 days".

    £175 is the diference between the full charges and the reduced fee level of £12.

    Clearly this is a LOT less than I was claiming and I don't want to accept as a final offer.

    What do I do?

    - Do I wait for the cheque, cash it and then reply saying, "thanks I'll accept it as a partial settlement but I'm going to proceed to court/ombudsman for the whole lot anyway"

    OR

    - Write back now, before the cheque arrives, saying, "no, not good enough, I'm going to proceed to court/ombudsman for the whole lot now"

    I don't know what to do for th ebest but I feel very short changed being offered just £175. :mad:
  • Depends if you need the cash now really...if you do, cash the cheque with a letter sent back, saying you accept as partial settlement.....either way proceed to small claims straight away.....Ive done 8 seperate small claims on banks etc and it is easy and very very effective!

    Hi - they haven't sent me the cheque yet. They're saying it will follow in another letter in 10 days.

    So I either wait for the cheque, then wait until it's paid in and cleared and then write saying no, I want the full amount, I'm going to court.

    Or I reply now saying I want the full amount, I'm going to court. And risk losing the offered £175
  • just cash the cheque then demand the remainder with threat of further action if they don`t cough up , did that & got the full amount on three cards they pay up every time .
