    Hey - do a search for my posts. I've just been through this process wtih MBNA.

    Use the 14 day timescales - realistically you're not likely to get a response from a huge firm (who are probably dealing with 100s of these requests!) within 7 days. Yes be strict, but also be realistic.

    In my experience, MBNA always replied but took it right to the wire in terms of timings. All their correspondance arrived either on the 13th day or the 14th day. I was all braced to chase them up or start proceedings and the letter always arrived, albeit at the very last minute.

    And see my sig - I won in the end :)

    Thanks for your advise on MBNA, and you were spot on by saying they leave it until the last min, Received a letter from them this morning offering a quarter of what i am claiming back from them, so it looks like i,m on the right track to a full refund of charges.
    Can you let me know were i can find a template letter to accept the payment but request they pay the full amount back or i will proceed with the ombudsman or court action? I have heard of the letter on the site but cant find it?

    Glad you heard back, albeit with a rubbish offer.:mad:

    I got the full amount back (see my sig) in the end so do persevere.

    I amended the template mail to say the below - pasted from my mail to MBNA (figures are dummy figures):


    I refer to default charges applied to my account amounting to £500 plus interest – an amount totaling £700 as of 21st October 2008 - which I have requested you pay back.

    I wrote to you on 21st October 2008, making the original request for a payment in settlement of my claim.

    In reply to my request, I have received the attached letter <copy of their letter offering a partial amount>. I will accept your goodwill payment of £150 in partial settlement only.

    As I have not received a satisfactory response to my original request sent 21st October 2008, I am writing to inform you I intend to claim the full amount claimed together with interest up to the date of judgment and court fees in the proceedings through the county court.

    This is based on the Unfair Terms in Consumer Contracts Regulations, as I believe these default charges are unfair and not proportionate to your costs, and therefore the court will rule in my favour. As I am sure you are aware, the Office of Fair Trading also stated in its April 2006 statement into credit card charges that it considers charges are at a higher level than is legally fair.

    I have attached a full schedule of the charges with this document.

    I look forward to a full response to this letter within 14 days, otherwise I will commence court proceedings to reclaim my money.

    Thanks for the reply . Ive just phoned them to request info on all charges made against my account . Ive been given an address to write to .

    If you do not get a written reply within 40 days then use this number 01244 672000. Its thier customer advocacy number . I found them to be very helpful

    Hi - does anyone know how I can check if this is still the correct addy to send a complaint to MBNA/VIRGIN as they seem to be keeping it well-hidden from me.

    Yes, that is still the address. I sent a letter today to that exact address.

    I would also like to know this please?

    Claimed £834 (including interest) from Virgin, gave me £169 as goodwill, wrote another letter saying I will accept the £169 in part settlement and want the rest or i'll take you to court and gave them 2 weeks to pay up the rest. Today (11/03/09) is the 2 week deadline and have heard nothing from them.

    Should I start MCOL now or give it another day just in case?

    i'll be going after MBNA ... they only paid 49% of what i originally claimed. Any one else had the same?

    sent a second letter to these guys today with a 14 day time scale on it - they replied to the first with what i assume is the standard fob off letter. do they have a track record of defending themselves in court?

    I have just received my list of charges from MBNA following the DPA request.

    Im slightly confused about how much of the charges I should claim back - the listing shows lots of "Late Fee Charge" £20.00 and "Overlimit Fee Charge" £20.00.

    Do I claim the full £20.00 in each case or £8.00 in each case ? ( £20.00 - £12.00 )
