  • Does anyone know whats happening with reclaiming. I am claiming £2k from Natwest but mine was with the courts when they decided to do a court case. I have been waiting over a year now???

    Cases are still stayed until the outcome of the OFT test case. The FSA waiver on stays runs out on Jan 26th, but is likely to be extended (probably for 6 months)

    I didn't think reclaiming credit card charges was on hold?

    I've read Martin's guide on reclaiming, but MBNA have replied to my first letter claiming for credit card charges with a two sentance answer:

    'Thank you for your recent communication. We are currently investigating your complaint and will provide you with a full response by December 21, 2008.'

    The letter I sent was a word for word copy of Martin's template.

    So what would you kind knowledgable folk recommend?

    If mean the initial request and not the DPA request, you would have specified 'I look forward to a full response to this letter within 14 days'. So when that time is up, you send the next letter.

    You need to dictate the timescale and stick to it, otherwise you may experience delays on their part. Be firm but polite.
  • I also sent a letter requesting breakdown of charges to MBNA on 19/11/08 recorded delivery. They signed for this on 20/11/08 and I haven't even had an acknowledgement yet. I also used the template letter on here which states they have to reply within 40 days. Wish I'd have seen this thread earlier!!

    Just for info... On the same day I sent same letter to GE Money, again by recorded delivery, the post office have now confirmed that they have not attempted to deliver this letter, but don't know where it is (including my £10 postal order!!!!!!!!!!!!!!). I now have to start allover again. What's the point of sending recorded delivery etc when the post office can't deliver (the service and the letter apparantely). Double GRRR:mad:

    MBNA withdrew the card and we are paying the balance monthly by DD, no arrears by the way. I am fully expecting that any reclaim will be credited to the card account which means it will only reduce the balance, I won't actually get the cash. Can I object to this and demand a refund direct to me not to CC account?

    I am after a bit of advise on the second letter to send to MBNA, i have sent the first reclaiming letter to them requesting full repayment of charges, and they have responded by saying they are currently investigating my claim!!
    I am now looking to send the second letter that states i will be taking them to court, but i have seen 2 letters on the site, one that gives them 7 days to respond and the other is 14 days, any help on which one to send wpould be greatly appreciated:confused:
