    Hey everyone thanks for your opinions. Oh the cheque didn't come with a letter just an acknowledgement slip! and the response i got a few days before the cheque came doesnt say full and final settlement anywhere. It says...

    'We would therefore like to offer you a goodwill payment of £429. I have arranged for this payment to be sent by cheque within the next ten days. I trust that you will find this an acceptable resolution'.
  • I have an MBNA card and due to late payment by one day have been hit with a £12 late payment fee which even though is the recommended amount seems a lot for one day!

    Is it possible to claim for this? I have rang up MBNA and explained that this is the first time and that I have been a customer for a long time. However they have refused to refund the amount even as a goodwill gesture.

    Has anyone been successful in any recent claims?

    Any help appreciated.

    Yes they should be considered to be a penalty until they step into court & prove otherwise.
    I successfully reclaimed them as have many others.
  • Hi We are trying to reclaim approx £1000 from MBNA. On the 14th day after my initial letter reclaiming the charges they have sent me what seems to be a holding letter to delay the proceedings. It says" Thank you for your recent communication. We are currently investigating your complaint and will provide you with a full response by April 21 2008. In the mean time etc etc.

    Now in my mind I consider that an "Unsatisfactory Response" and am wondering whether I should wait until 21st April for their letter that will no doubt reject my claim or whether I should now proceed and tell them that their response is unsatisfactory and they have 14 days until I am taking them to court!

    What do you think.

    btw - Have posted 2 letters to Lloyds today giving them 14 days before I go Legal!

    Stick to the timetable specified in your letters. This question and other common queries are answered in the Reclaim Help guide, link in my signature. Probably worth a read through in conjunction with the Reclaim guide.

    Hi,

    I too am claiming from mbna.

    I sent my initial letter on 19/2/08 asking for charges back as i already had my statements. I received the same reply as you saying 'we will provide a full response by 23/3/08'. This letter was dated 28/2/08.

    I received the reponse on 13/3/08 offering me half of what i asked for. About 2 days after this i actually received the cheque for this amount! So their responses were quite quick. I'm currently waiting for a reply to my second letter in, which i basically said thanks but no thanks i want it all!

    So in my opinion i'd wait you will get an offer i'm sure. Hope this helps.

    BTW i asked for £850 plus interest
  • I have just been overcharged for a late payment fee of £13.82 by MBNA..:mad: I was furious as my current account(HSBC) was debited on the same day the fee of £152.87 had to be with them(25th March)..I phoned them up,but they said they cannot take this £13.82 off the sytem:confused: :mad: I will certainly not deal with MBNA anymore and I think it's ridiculous that a fee cannot be processed on the same day on the internet..:mad: :confused:

    It takes 4-5 days for a payment to move from your account to your credit card account. It would tell you that on the back of your statement.

    Doing a bank transfer on the day it's due will (rightly) see you being charged.

    You're right to say it's ridiculous, but hopefully by the summer the banks will be doing something about it and transfers should take no more than 24 hours (the new system was meant to be operational now, but they keep delaying it due to glitches). However, it's well known that it currently takes between 3 and 5 days for money to reach another account / credit card and it's advertised everywhere, a lot of banks even highlight the fact when you action the transfer online.

    You will also have a late payment recorded on your credit report which will impact your ability to get credit in the future and if the late payment fee takes you over your credit limit you will have more over limit charges next month.

    Personally I have little sympathy for people who don't keep up repayments as it's people like this that push the rates up for the rest of us, fortunately we have a system which identifies good and bad credit risks so the responsible among us can get good deals.
    I've given up trying to get my signature to work with the new rules, if nobody knows what the rules are what hope do we have?
  • I know it takes 4/5days even electronically but,yes,it's a mystery that their charge comes out the day after on the 26th?:confused: even though the whole bill was taken from my account on the same day(25th) ...:confused: Broadband better pep up it's speed,as I could of paid it quicker by walking there ..:p :rotfl: :confused:
