  • Yes I would send them the 'part payment and without prejudice letter' as this shows that you are not accepting this as final.
    But to be honest I received a part payment and it was within the 10 days but I did the LBA and 'without pejudice' in the one letter and today I have received the offer of the rest of my claim including interest - it was just over the 14 days that I gave them but saved having to pay out to file a claim.
    If you are prepared to wait abit then you might be in luck also. I didn't even work out the interest but they have given me (when I get the second payment) £168 more than I asked for so all good for me!

    Wrote to Virgin/MBNA informing them that I cannot pay what they are asking and included a budget sheet. I also included £10 cheque and requested my statements under the Data Protection Act as I have had quite a few charges added to my account and this is what has sent my credit card spiralling out of control. They have just phoned me to say that they have used the £10 cheque as payment for my credit card - what do I do now? they have still got 23 days to send the statements as the 40 days has not expired. Do I write to them and re-iterate that the cheque was for my statements and are they actually allowed to do this?

    Any advice would be most helpful :rotfl:

    I hope so. Tomorrow is their last day for them to reply to my letter saying that I'll accept first offer as part payment, but will take to court if they don't pay the rest. So fingers crossed........

  • My husband has just made a repayment plan with MBNA to pay back his £10,000 credit card. My question is if he claims back all his charges can they call the whole amount back immediately?

    I'd be very interested as i'm owed approx £4000 by MBNA in charges but am on an IVA and would love to find out if the repayments will go straight to my debt or not?

  • Hi, They did the same to me when I got my statements and I have just received a £10 cheque back with an apology as I had made a complaint about several things. They actually wrote me a nice letter back with my statements saying that I hadnt been charged! I am still waiting on a reply about somethings, but that arrived first.

    I think if you have an outstanding balance on the card and are on an IVA it may be considered "excess cash" that they know about and i wonder whether it would be recommended to just let them pay the debt off. Would be curious to know how you get on.

    I've been made an offer by Abbey on Credit Card charges dating back to an account I had with them from 2000-2004 They have made an offer equating to approx 25% of my original claim. They have sent a cheque to me too.

    Now I would like to go for an increased offer if not a full refund. What would the advice be here ... i.e. accept the cheque as part settlement and go after the difference or return the cheque to Abbey (MBNA)

    The wording in their letter goes like this:

    " we wish to resolve your complaint to your satifaction. We would therefore like to offer you a goodwill payment of ..., which would effectively reduce all of your fees you have paid, to the reduced level of £12. We must reiterate that we do not accept the OFT's position, and that this payment is offered solely as a matter of goodwill. I trust that you find this an acceptable resolution "
