Today I was about to begin MCOL proceedings against MBNA. I was just going to work out what interest they owe me and crack on with things. Then their half-offer of £321 dropped through the door.

    SO...

Does this mean I've got to now give them more time before starting MCOL by writing to MBNA and accepting it as half payment? And where does this leave me with the interest I can claim? Do I work out what they would have owed me before the £321 and then take the refunded amount off the net total?

How long do I give them to send me the rest of the money?

    Help!!

OR do I just not bother with the MCOL yet and write to MBNA again, saying that I accept the part payment but unless they want to pay interest and court fees it would be better for them to pay the rest of the cash within the next week/ 14 days...

Please advise, would like to get this sorted asap.

I don't intend to lose another day waiting for a reply, so if I don't hear anything back today I'm going to start making my own decisions! Hah!

Do I accept the partial offer and:

    a) proceed with MCOL - if so how do I work out what interest they owe me given that they've paid half of what they owe me already
    b) write back to them and say "give me the rest of the cash or I WILL start MCOL proceedings"

OR do I refuse the half-offer entirely and demand the full amount:

    a) via the courts
    b) appeal to their common sense and avoid the court business altogether

OK so now they've sent me a statement saying they've credited £321 to my account (which was closed about 18 months ago). But they've sent me a cheque for that amount!

    What does this mean?

Well I've written back to accept it as partial offer.

    Thanks so much.

ive started claiming on one of my MBNA cards as the balance is clear im at the second letter stage they have a 4 days left claiming £306. There is no outstanding balance on that account but i have another MBNA card with a large balance on it. Is it safe to start a claim for this card will they close my account or change the interest rate etc? not sure whether to take the risk as theyve given me 7.9% for a large bt.

I write here more in hope than expectation but shall do so nevertheless.

MBNA's deadline to send me the rest of the cash has now passed and I intend to start MCOL today.

They now owe me £324 (since I accepted their goodwill payment as partial offer). Do I need to write to MBNA demanding that amount plus the MCOL charges? The impression that I get is that once the MCOL paperwork is delivered to MBNA that they instantly pay up without any further fuss?

What about interest? I gather that since I've accepted the partial-offer that this is no longer an option - after all, how would I work it out?
  • hi

regarding interest i would work it out at the date you were paid the part payment.
that will give you a total including interest you want to claim.
then take off the part payment.
work out the daily rate of interest on the remainder. 0.0219% i belive it works out to at 8% pa.
count days between part payement and court claim and add that figure x 0.0219% to the claim.

the daily amount is automatically added from then on.
sounds complicated but take it step by step and it should work.

    good luck

I can't even begin to work out how to do that

Maybe I'll just go for the £324.

    Hi
I sent MBNA a letter on 5th July they signed for it on the 6th July, since then i haven't heard anything. they have credited my account with a goodwill gesture, but the letter i sent was requesting more.
I haven't been able to get through to anyone in the customer advocates's office for weeks.. its just a recorded message. I'm stuck what to do.
On Tues last week i started a SCC but as its an english address and i am in NI, i had all my documnetation sent back to me.
Can i do a SCC in England without being in England?
Does anyone have any ideas... i so want the rest of my money, but feeling so stressed with their lack of interest and apathy when i contact customer sevices ( i rang them 2day at 1pm and apparently they will ring me back within the hr....its now after 3pm)

Before they sent me the partial offer, MBNA owed me £645 + £149 in interest giving a total of £794. Now that I am proceeding with MCOL and have to claim an exact amount from MBNA, do I just take the £321 from the £794?

If the amount is wrong, surely MBNA will contest it?
