  • I have successfully claimed with Halifax and Lloyds TSB and am helping my auntie claim with Abbey but they all do things differently which is a bit confusing!!!

    I'm now trying to sort my MBNA claim out and need advice before I proceed further. They sent me a letter offering part settlement as goodwill payment etc, which I accepted as part payment 'without prejudice' and gave them 7 days to pay the rest or I would go to court. They have had a bit longer as I've been away but as I've not heard anything I was going to proceed on Moneyclaim.

    My questions are:

    1. Should I word Particulars of Claim differently as I'm asking only for the remainder of claim?

    2. Should I put cheque that they have already sent in the bank now or wait?

    I would appreciate anyone's help on this!

    Hi, I sent off a letter to MBNA asking for 6 years worth of charges, letter sent on 18th June.

    I didn't send it recorded delivery ( no time to get to post office ) and I've had no reply as yet and they haven't cashed the £10 cheque either.

    Do I wait some more and then send the same letter again but recorded or do I take it to stage 2?

    Hi i had the same problem so i gave them a call and within two days a full list of charges had arrived !!

    Oooo spooky, just got my list of charges today for free....wonder if they read this board :rolleyes:

    £367 in total...interesting how fees start at £18 in 2001 then up to £20 in 2002 and finally up to £25 since 2003.

    All charges are for 'Late Fee' and 'Overlimit Fee', I assume I can claim all of these back?

    Many of the credit card companies are now sending lists of purely charges for free now and are quite quick.

    Personally, after reclaiming over £7000 in fees from banks I've taken the line with the credit card companies of claiming everything over £12 as a quick settlement.

    To calculate this I've added-up the amount in £'s the charges total, and then add-up the number of charges. I calculate the number then by £12 and then take that total off the total paid. That gives me the refund amount.

    Example:
    Charges paid - £400
    Number of charges - 16
    Number of charges (16) multiplied by £12 = £192
    Charges paid minus £192 = £208.00 to be repaid

    I include this simple formula with a covering letter and a copy of the OFT report and I've been getting refunds within 14 days with no fuss. My finances were a mess (but with MSE now recovered :money: ) but its nice to get cheques popping through the door once a week for an average of £200

    Of course, you may choose to push the full amount, this is your choice but will take longer.

    I've done this with MBNA and they settled within 2 weeks of my original request for a list of charges

    Finally, you can claim all those charges marked late fee and overlimit fee

    I sent a letter to MBNA on Saturday telling them that since I hadn't heard from them I would give them another 7 days then press on with MCOL. In the meanwhile, however, they sent a letter to where I used to work to say their charges are fair and they offered £321 (about half of what they owe me) as goodwill.

    Clearly this is their SOP and the thing to do - I hear - is to accept this as part payment and go ahead with MCOL? This all seems to be winding up quite quickly.

    Any advice gratefully appreciated.

    Oh yeah, if I do have to resort to using MCOL, do you have to pay the fees upon registering your claim or does this only happen when and if it actually goes to court?

    You pay in advance, when you register the claim, so you have to remember to claim this amount within the total claimed.

    Its the same process if you claim through your local County Court
