hi guys could sum 1 just help me out wiv a quick question asked for my charges back of mbna of £1,500 ish got a good will jesture of £690 credited to my account as i have just recieved the statement this morning need a letter saying i will accept this as part payment without predjuice, now on me statement to day cos they have done this , they wanting me to send me credit card back (how nice of them ) lol so i still got a balance owing but not allowed to use me card no more, can they do this, am not bothered about using the card no more will have to do mcol ,cos i added it all up last nite and wiv interest its nearly £2000 so if i take the £690 its still like £1300 short ,if i do mcol will i lose me court cost cos the way i see it they will just take it of me balance i owe them but then i will only owe a few hundred quid , but in my eyes least thats better than owing £2000 hope it makes sense cheers jill0

I have recently worked out that MBNA have charged me £726 (£828 including interest) in charges over the last few years, so I wrote with the usual letter.
Today, they have said the charges were valid but would make a goodwill payment of £320.
Coincidentally, £320 represents (more or less) the amount they have 'over charged' since dropping their fee from £25 per month to £12.
MBNA also say that they disagree with OFT's interpretation of the law and their charges are fair, legal and transparent.
I have 3 choices
a) accept the offer
b) transfer the £320 away from MBNA and take the issue further
c) contest their response.
Any thoughts?0 -

It's your decision, personally I would pursue the whole amount, but this will take longer. Only you know your personal circumstances and whether accepting part payment is good for you. Bear in mind if you sign up the partial amount as full and final settlement, you cannot change your mind and claim for the remainder at a later date.0 -

Obviously, it all depends on your circumstances and the amount involved (both in real and percentage terms) but, personally, I regard any part offer or payment as an attempt to take some of the charges from you for a second time.

I'm in a similar situation (claimed £605, offered £250) - although MBNA have (rather arrogantly i thought) made the decision for me by sending me a cheque for the £250.
Can i cash the cheque and send them a letter asking about the difference?I have no more money to give - all you companies out there - do your worst - I give in!!0 -
I have registered my claim with MCOL waited the 5 days for the claim to start and also waited a further 14 days also for the banks responce. The bank are defending and they dispute the whole of my claim. I'm not panicking however this is the unknown for me any guidance/reasurance would be helpful. Also what happens next? I phoned MCOL and they said that the banks defefnce is that they will pay the whole of the amount (£700 - paperwork to arrive in 2/3 days). Great news but very confusing! I think I have won.
BINGO - Cheque for full amount claimed arrived mid-morning. Is'nt it a weird and wonderful world.
The bank says that they dispute the claim and will defend the case, then in the very next breafh they say here is a cheque for £700 and wil I stop the proceedings. Eureka!!! :j

Capital One did that to us, simply to buy time - they sent us a letter agreeing to refund the whole amount by cheque within 14 working days or something, and that they would defend the case on the grounds that they have paid us. We got a notice from court that Cap 1 had said they had paid and to send them a form back saying whether we agree and want to discontinue the claim or not. We waited till the cheque came and was safely deposited in our account, then we sent the form back. You have 33 days to do that so don't rush - WAIT until you have the money!Reclaimed thanks to this site:

Sounds like you have to me aswell mate but as Beate said hang fire til you get your cheque & its cleared in your account, then cancel the claim

Looking for some sensible advice, I'm trying to claim back £1400 in charges from Mbna
Today i got a letter back from them stating their charges are fair,the usual flannel!,but as a goodwill gesture they have offered £530.00 as a full and final settlement.
Now the poser... I have been in a battle with Mbna for a month for an interest rate reduction which i now have got so do i still send the next letter accepting the money as a part payment.

Accept the gesture, then tell them you cannot accept this as a full and final settlement and claim the rest. I did with the A & L had it all sorted within 6 weeks.0 -
