Well I wrote to MBNA listing all my charges and asking for my money back which i calculated off every single statement i kept so i had no need to ask them to send me my statements but got a letter back yesterday from someone who deals with subject access requests saying thank you for your request (didnt request my statements!) and please find enclosed list of charges! Whats that all about?!
Think they are getting slightly confused so I am ignoring this letter and proceeding on!

I got my SAR back from MBNA yesterday and did a quick calculation that they owe me £600 in fees of £20 and £25 for overlimit/ late charges. Do I claim the entire amount or do I have to "let" them have £12 of it?

I am just starting to claim for my charges. I am now being charged £12 for my charges but would also like to claim these back. Could you possibly message me a copy of your letter declingin settlement and asking for full payment of charges.

And they settled within the 28 days of the Moneyclaim forms being issued to them. So in a nutshell, stand firm and persevere anyone who goes after them!0

Yes, it is. The risk is that the bank/card immediately request that you repay what you owe them, but if the charges are enough to cover that, don't worry about it.
Take Martins advice though and set up a back up account with anothe bank just in case.0 -
I have a huge overdraft with Natwest, and I still was able to claim over £2000 fees. They paid up and I have not had to close my account nor even pay off the overdraft yet (I've chosen to pay the credit card balance first)0

I got fined by MBNA for £12 recently. I rang up to ask for this charge to be removed .. ( i hardly ever use the card, I spent £5 and the payment was a day late because of the bank holidays).
They gave me back half.. I thought that was a bit harsh so I asked for the account to be closed straight away.
They are now threatening me with legal action for £6.23 (as they are adding interest!).
Should I ignore or should I pay and then claim it back. I know its only £6 but I'm a student and its the principle!!!!!!

Even for half of just one £12 charge, I have to say that its worth a try. Who knows, you could also end up with the MSE record for the smallest amount reclaimed!
I would recommend paying the account off first. It stops any possible counter-claims and gives you the "moral high ground".
The Office of Fair Trading’s figure of £12 is still “extravagantly” higher than the cost of automatically administering a late payment and therefore unlawful. All that happens is that the credit card company’s computer adds the charge to your account. I didn't even get a standard letter. You can use the bank charge letter templates with a little bit of customisation. The credit card companies will try to use the OFT ruling as justification that the charges as correct.
Unfortunately, the Financial Ombudsman will only request the difference between the current £12 charge and any older and higher charges so is not an alternative to court proceedings for these claims.
Make it clear that you accepted the £6 as a part payment and "without prejudice".
The one advantage with claims for such low amounts is that is even less cost-effective for the bank or credit card company not to settle. If you do have to issue a court claim, they immediately owe you an extra £30.
