    I've tried to get help on Abbey forum but not answers yet! I have similar case to this - Abbey card and I've gone ahead, as far as second letter stage, when I have not received a letter from Abbey saying they have passed it on to MBNA. I was about to proceed with MCOL but am having doubts. Are they saying this to lots of people do you know? I would have thought the claim was with Abbey anyway (credit card) but now unsure.

    Many thanks for any advice! Also if anyone has actually gone ahead despite a bank saying MBNA are responsible as the account is registered with them, and won, I'd be very grateful if you could let me know!
  • MBNA have been co-operative so far and I'm happy (famous last words)

    I sent off my SAR, with a copy SAR including photocopied ID 10 days later.
    1 week after SAR deadline of 40 days I have received a letter acknowledging my SAR request and as per Data Protection Act 1998 herewith enclosed my list of charges.

    I haven't got a clue if they are correct but I am happy to go with what they have sent me. It appears they run the search on the following fee types:-

    Fee Type 12 - Late fee charge
    Fee Type 19 - Over limit fee charge
    Fee Type 21 - Non sufficient funds fee charge

    I just have replied asking for monies to be returned etc ...

    I hope this helps all those people who ask the question "what can we claim for"

    Up until the last few days, when Abbey decided to issue their own cards again, all Abbey card accounts belong to MBNA - it is true that any request ssent to Abbey get forwarded to us (meaning MBNA). They arnt trying to fob you off or anything, but it HAS to be MBNA that deal with it, Abbey have no access (to my knowledge) to Abbey credit card account held by MBNA (which as I said, until the last few days is all of them)

    Oh I see! Now it makes sense. I wondered why Abbey had replied in the first place, if the account was registered with MBNA. But this is a recent change, so they are now passing the letters on to MBNA for former accounts. So I will chase the rest with MBNA.

    Could someone advise the correct address to use for requesting statements?

    Also, do MBNA ask for the £10 fee for this "service". Have been through the process with Capital One and they sent them through without charge.

  • hi i sent my letter to mbna u should find the address on ur statements and i sent £10 and they cashed it so it looks like u do have to pay mbna for them cheers john

    Have today been offered 100% of what I claimed. Just over £400. It took a few months. They initially offered the difference between the charges and £12 in each case. I rejected this (said I would accept as part setlememt only) and asked them to provide proof of their expenses to justify the charges. They have just offered as full final settlement and without admitting any wrong doing 100%.

    Proves this system works.

    Halifax WON! Claimed £1549 on 8th Jan 2007, Settled for £1350 on 29th Jan, Paid 7th Feb.
    MBNA (Virgin / Alliance Credit Card charges): WON! Claimed £419 on 17 March, finally offered £425! on 5 June)
    Natwest Credit Card: WON! Claimed £250, got 100% + interest + court costs too.
    Northern Rock: Mortgage Discharge Fee: WON! Claimed £100. Offered £90 and accepted it.
    Natwest Bank / RBS: WON! Claimed £400. Got 100% + interest + court fees back.
    Halifax 2: Ongoing....

    I am just starting to claim for my charges. I am now being charged £12 for my charges but would also like to claim these back. Could you possibly message me a copy of your letter declingin settlement and asking for full payment of charges.

    first letter for SAR i sent to Customer Advocates Office
    MBNA PO Box 1004 Chester

    all other letters go to MBNA Europe Bank Ltd
    Stansfield House Chester Business Park Chester
    Cheshire CH4 9QQ
    I sent cheque for £10 and it was returned to me.

    I got my SAR back from MBNA yesterday and did a quick calculation that they owe me £600 in fees of £20 and £25 for overlimit/ late charges. Do I claim the entire amount or do I have to "let" them have £12 of it?

    MBNA seem suspiciously accommodating with these requests. They didn't even cash the £10 cheque I sent them. Maybe they know they haven't got a leg to stand on?
