Hi guy's, I hope someone can help. my brother sent off for his statements from MBNA. They have sent statement information, returned his £10.00 cheque and arranged for a goodwill gesture to be credited to his account for £190.00. (before he has even asked for his money back)What they have sent is very difficult to understand and they say in the letter, "should this information be insufficient for your purposes and you wish to make a full data subject access request under the Data Protection Act 1988 please complete and return the attached form with a cheque for £10.00. (Is it just me being ga-ga or is this not what he done in the first place) I know he can claim late fees, overlimit fees, but was wondering can he claim retail interest (which runs into thousands) or is it worth asking again for the information, which we might be able to make sense of. Any help on this will be much appreciated. Many thanks.0

It depends on how the original SAR was worded, if he didn't ask for ALL information then they wouldn't have sent it all, which is no doubt why they haven't charged you.
Personally I think it's a mistake to add the "if you can't send me the manual entries etc, then the statements will suffice" as the claimant is giving the banks an opt out. What is really required to increase the evidenciary weight against them is to get the manual entries (if there are any, and if not a statement that there aren't any) AND the statements.Hamsters have no tact and diplomacy, nor do they want any.0 -

two weeks ago I wrote to MBNA with the '14 days or court' letter. I got a letter the next day saying they would reply to my complaint (probably with ref to my first letter) within 14 days. 14 days is up on friday, but today Ive got another letter from them saying they will reply in another 14 days.
Should I give them the 14 days, then do MCOL, or do you think they are stalling for time?
Im already doing MCOL for Lloyds and Mint, so another one wont be a bother - it would just be easier not to!

I have had to wait about 47 days for the statements to arrive. After day 39 I wrote to the complaints department threatening them with the ombudsman and infor'n commisioner if they did not respond within 7 dsays. Today,dealine day, they arrived on my doorstep with the chq returned.
Stern words and letter headed 'COMPLAINT' will get you everywhere.

Sent my 1st letter to MBNA (3 seperate credit cards), the 14 days is up next Tueday. Had a letter today saying thank you and they will give me a response on the 24th May.
Now, can they do this? Isn't this stalling? i have clearly given them 14 days?
Should i ignore this and send the 2nd letter saying unsatisfactory response, give them another 14 days and then court porceeedings? (letter 2) or wait??

Recieved a letter back from MBNA concening my request for my Credit card statements. They have just sent a letter of all charges dating back to 2003 and returned my cheque to me. Thats nice of them. I am going to sent the next letter now asking for a refund. Can I ask for a refund for and I am claiming late fees and overlimit fees. In 2006 they started to charge £12 as per the OFT ruling.
I can not claim this back can I?
Could I also ask for a cheque instead of returning it to my credit card?
I also asked them to cancel my PPI with them and I am still getting charged that on my statements. I sent the letter back in March.
When I sent the second letter off should I ask for a refund for the last two months and enclose a copy of the first 40 day letter that I sent explaining that I wish to cancel my PPI as I think that sometimes they do not read the letters that they get sent and just look at the first line.
