  • I've just received copies of my statements from MBNA going back to Oct 05. The are showing late payment charges at £12 each. As I've not got the original statements I can't double check but I'm positive that on the originals I was being charged £25-£30 late payment fees!!!

    CAn anyone confirm
    1) can I claim these late payment fees back
    2) does anyone remember if and when MBNA altered their late payment charge down to £12 - I think they've altered my statements!!!!

    Certainly sounds like it as it was only last year that the OFT ruling suggested the fee be £12! Hopefully someone can tell you exactly when MBNA changed their fee charges.

    I have recently recieved a letter from mbna offering me a goodwill payment in respect of my claim . It clearly states on this letter that "Prior to July 2006 , term 3b of your credit agreement clearly stated that you must pay £25 each time your payment had not reached your account within one day of your payment due date , or when you exceeded your limit or a cheque was returned unpaid ".
    So it looks as though Mbna changed their charges in July 2006 and might well have altered your statements :eek:

    ive just read through the letter again and it says that with effect from 28th june 2006 mbna reduced their default charges to £12 for late / returned payments and from 28th july 2006 for overlimit fees .

    Hi Cashfome,

    I've just checked my old statments and also the printout they sent to me. The printout only goes up to 07/12/05 and they were still charging £25.00 for late and overlimit fees.

    The statements after that charge the same until 07/08/06 which then changes to £12. Bluesunshine is right, it came into effect in June but looks like they'd already implemented it on the statements for that month.

    But in anticipation of this being a part payment, does anyone have a draft letter for this?
    Also, if it is a part payment, since I am due to take submit a moneyclaim form tomorrow, how do i calculate how much they want owe me?
    Do I just calculate the full amount they owe me and deduct the part payment from the balance? How do i represent this on my moneyclaim form?

    Don't know if other people do it differently, but when i have been recvg a partial offer from credittors, i've been writing back declining the offer and then just claiming the full amount on the MCOL forms.

  • Ive still got a credit card with MBNA with about £3000 still owing on it .They've just refunded me half of what i originally claimed with no mention of closing the account . Credit card companies make money off you if you have an outstanding balance so i can't see them closing your account .I think in most cases the amount they make off you in interest charges would probably outweigh what the may pay you in the way of a refund
