    I followed Nickmack's advice and sent a 7 day letter on 20/2 threatening court action but also that I would accept £360 as partial payment towards full claim of £900~ . I received a cheque today of £360 with no letter (not sure if letters crossed in the post). Should I accept & bank this and then wait for the 7 days to be up before starting MCOL? If so, do I then enter the MCOL for £900 - £360 = £540?:confused:

    Hi Stug01,

    I'm in same position. I've today received a letter offering £870 as goodwill on £2121.... I was planning to send the letter as advised by Nicmack today accepting as partial settlement.

    Personally - if the cheque arrives I'll cash it. But in my letter I will be stating that as they received a letter on 22 stating that I would take legal action within 7 days - I will carry on with the legal action 0n 1st April for the oustanding £1251 plus interest plus cort costs.

    Good luck and keep us all posted. Without this site I wouldn't be where I am today!

    hi, i have had around 1500 in charges in 4 years with mbna. i soon went to default and could not pay them my total balance. about 6 months ago they made an ofer of 40% of the balance for full and final settlement, which i accepted. they said they would show my debt as satisfied however it would still show an outstanding balance on my credit rating.

    my questin is, can i claim back my charges from them, even though the account has been settled. I understand that i probably wont get the money, however, it would reduce the outstanding figure shown on my credit rating. wouldnt it? can anyone help?

    Hi

    I just received my charges off mbna. The letter says that they have provided the info free of charge but no cheque returned, i checked my last statement with the bank and they cashed it!! should i contact them and tell them?

    Secondly where am i to send the second letter cant seem to find the info on any of the forums?

    Lastly I filled in the calculator on the site and the interest came up with £157.96 interest from £1111.96. but worked out on a ordinary calculator at 8% then you get £76.32 from £954. Can anyone help and help me to understand.

    The interest is charged as per date of the charge which is why you see differing amounts of intrest on the same amount of charge..the older the charge the more interest is calculated...
    M.B.N.A did the same to us and cashed the cheque..
    they have acknowledged out letter asking for £694 inc intrest...but have told us they wont be bale to respond until 8th of april..14 days is up tommorow so will send out next letter regardless..
    the forum says to stick to the timelines so i shall!!

    As per my previous post - I received the cheque from MBNA on 28/03 (post marked 27/03). I had already sent a letter back declining this cheque for £870 as full and final settlement which they signed for by MBNA on 26/03.

    I have sent another letter stating that I will accept the enclosed cheque as partial payment and if I do not hear back from them I will file with MCOL.

    How long do I give them? In letter of 24/03 I stated they had until 1st April - but I've heard nothing back. Anyone any advice?

    Stick to your timeline dont let them dictate to you..this is often a stalling tatic they use to put you off..
    just out of interest have you just taken off the amount they have given you in a cheque from the total you asked for inc interest for you mcol claim..
    as i am in a similar position..i have accepted cheque without predjudce but intend on filing for the remainder via mcol just wondered if we had to go back an change all of the charges to £12 as thats the limit they have put the charges too and recaluclate the interest using martins calculater..
  • I have just called them about a late payment charge on my account - I did the payment on time online but it went out a few days later and ended up a day late! I just asked them for a refund and they were very snappy and basically said no because its a day late. The problem is the account balance has now started gaining interest.

    I originally transfered a balance of £700 which was 0% until Nov 2007. However as this late payment fee has gone on in Feb they have now charged interest on the whole balance on my last two statements as a result as the charge has made the whole amount liable to interest. I assume i'll be able to reclaim this back and what do we say when they quote the OFT.
