I requested my statements 13/2 and today received a letter with a list of my charges, my £10 cheque returned and a goodwill offer of £360! I checked the list of charges and found they owe me £906. If I send letter accepting £360 as partial payment, do I then start MCOL or send lba? Also, do I have to send letter or is there a phone no I can call?

You should still follow the procedure for the rest of the money, so you can't jump straight to the court stage.

You should send all correspondance by recorded post rather than phoning or normal mail.

Has anyone requested statement data from MBNA and then received a list of charges over the period and not charged you the £10?
They said they have provided this information free of charge and have not treated this request as a full subject access request.
The only thing is I don't know what to do now because I have no idea what charges I have incurred over the last six years and should I believe what they have sent me??
    Can anyone help??????

    Hi Car 1268,

I got exactly the same information sheet from them as well. I basically re-typed their details out which listed 2 lots of items all the way through:

    Over limit fee
    Late Charge

I then broke it down with a total for each year and sent it off (recorded or they'll deny they got it). Received a letter within 3 days saying they were looking into it.

If there's any other items listed, put it on the forum and someone will be able to tell you if you can claim them.

    Good luck, S
  • I'm currently in alot of debt on my virgin credit card and currently not paying interest. I'm thinking of contacting then about what charges have been applied to my account to see if they will take then off but worried just incase they turn around and say they want the rest back upfront. any help or advice appreciated.

  • Hello,

I have been scouring the forums for any info on if I can reclaim for cheque handling fees on my husbands mbna credit card?
There are so many posts and I have yet to find anything concrete either way. He has quite a vast some and they do seem rather excessive charges.

If anyone could help I would be very grateful.

I followed Nickmack's advice and sent a 7 day letter on 20/2 threatening court action but also that I would accept £360 as partial payment towards full claim of £900~ . I received a cheque today of £360 with no letter (not sure if letters crossed in the post). Should I accept & bank this and then wait for the 7 days to be up before starting MCOL? If so, do I then enter the MCOL for £900 - £360 = £540?
