    I am responding to Egg's baffling options with the following letter. Your advice is appreciated:
    Dear Sir or Madam,

    Re. Account number: xxxxxxx – Loan
    Account Number: xxxxxx – Credit card

    Thank you for your letter dated 14th May offering me three options relating to my request for statements for the above accounts.
    My original letter to yourselves was requesting the statements under the DPA and gave you 40 days to send them. As you know, this is exactly the same as the third option you offered me, therefore I will proceed with this course of action. You are no doubt aware that the 40 day timeframe began when I sent the initial SAR letter and the deadline is still 11th June 2007.
    I have also re-sent the cheque that you returned.

    I would value your advise. My partner and i have been trying to get bank
    charges recovered since February. When the bank statements arrived 2 years
    were missing between July 2002 and July 2004. We have been in and out of
    banks, called telebanking numerous times, sent recorded letters etc.
    However, we still don't have them. So far, without the missing two years,
    the amount comes to £618 with interest. However, the missing two years
    will be at least double this as my partner was particularly bad with
    money.

    Is it possible to put in a claim for £1000 (including interest), without a
    schedule of when charges were taken? We've got a baby on the way and could
    do with the money. Should we perhaps use 2002-2004 = £550, 2004-2005 =
    £300
    to the amount before interest than add the 8%?

    I look forward to hearing your advice ASAP.

  • I've written to egg and asked for statements. they have written back and asked for proof of address which I am providing.

    Also taking on Virgin (sent away list for claiming back, they also didn't charge for it) and Capital One - no reply to original letter re charges, but cheque cashed :(

    Between them I am determined they are going to pay for my holiday in September/October!! :D
    I have no more money to give - all you companies out there - do your worst - I give in!! :(

    I'm trying to get back to egg before the 40 days are up otherwise it'll all go tits up.

    Your text for the letter is fine.

    What's the issue with the 40 days? Not sure if I understand your concerns here but I would say that this isn't a problem. It's a timeframe that they have to follow, not you. They should respond before 40 days are up and if they don't then you report them to the Information Commissioner for a breach. You sound like you are thinking that if they don't respond by the 40 days limit then you are not going to get your information but that's not the case.

    Obviously your problem is what date is the 40 days up. Egg will say that it can't be the 11th June as they have sent you a note offering you options and you haven't responded so that is delaying things. You could go back and say that you had asked them for a list of charges and enclosed a cheque for a tenner so why didn't they respond to that (like they have done for me and loads of other people). Maybe you need to call the Information Commissioner to ask them?

    What is clear now is that Egg won't be doing anything as they will be waiting for your response to their letter, so send your response and get things moving.

    That is my concern precisely. If I go for option 3 but then add on the 10 days I've failed to respond to them would it cause problems with the DPA request? I know how pedantic these things can be.

    I'm off next week but won't be able to access the net so I'll have time to pursue this guff but won't be able to request advice!

    Sorry, I hit the thanks button before the quote button! That will up your quote of thanks anyway!

    I really think you are making too much of this and need to get your letter off to them straight away, especially if you are away from the computer next week. They were quite quick with mine and they sent my cheque back as mentioned before so it will probably a case that they receive your letter and send the stuff straight off to you. They have to be concious of the 40 day thing as well

    As I said before if it goes over 40 days (or even 50 if you add the 10 days on) then you will still get your stuff from them as it's not a thing where the 40days expires and then the chance is gone. Once the 40 day limit has passed then you can start escalating it to the IC. You haven't even got to that point yet but if you do then you can start haggling with Egg about when the 40 days is up.

    Thanks for thanking me, I have returned the compliment!

    I'll continue with the DPA request then, give them until the end of June. I'm in no rush.

    Sent off my first letter today for egg credit card to claim £60

    Recieved a letter from Egg this morning says that they are not going to give the full amount in charges back which is £60.00 but £12 which is the difference betwween £20 and £16 which they charged from August 2006, not the £12 like the OFT suggested. I also included in both my letters that I would like my PPI cancelled and any PPI that have paid from March to be reimbursed back to my credit card, Which they have done and £62.34 will be credited to my account in the 2 days.
