Egg...

Dear Michael

The overlimit charges are imposed as soon as your account goes over your agreed credit limit, which is automatically carried out by our systems. It doesn't assess accounts on an individual basis and applies the charge whenever the limit is exceeded.

Therefore I'm able to confirm that the charges on your Egg Card are correct and I'm unable to offer you a refund for them

The overlimit fee is stated in our terms and conditions under '7.1 Charges'. You can view these online by copy and pasting the following link.

new.egg.com/visitor/0,,3_11087--View_1068,00.html

It also states in the frequently asked questions on the website, a ?16 charge will occur:

If you don't keep up with your payments.
If you go over your credit limit.
If a payment is returned due to lack of funds.

Thanks for your message.

Regards

At least they admit the process is completely automatic and therefore they can't use the manual intervention defence in defence.

  • In addition to reclaiming my charges from my bank accounts - I am also attempting to reclaim them from my 2 credit cards - Egg and Capital One.

Is anyone else reclaiming from credit cards? If so how have you got on?

I have requested £120 be paid back to me from Egg. They responded incredibly quick (in just 3 days) saying that they will not repay the charges and that if I continue to pester them they will close my account and will demand that I repay them the £800 that I owe within 30 days...

Have any of you been successful with Egg or other credit cards?

There is no way that I could come up with £800 in 30 days - should I just drop this one? I do not think that i am brave enough to continue this fight...

I was thinking - if I won my Natwest claim (of £775) I could settle my Egg card and then re-take up the claim for £120 - as they wouldnt have anything to threaten me with then - would they?

    Your thoughts please...

    Thanks guys

Many people have successfully claimed back from Egg. I helped a claim recently and they did not threaten to close the account, so it may be a new tactic. If you cannot repay this card or transfer the balance, you will need to wait until you are able to in case they carry out their threat. You may also want to ask them on what basis they are intending to close your account and possibly report them for this behaviour.

    They can’t do that.

But they can close the account for new transactions, demand the card back and expect you to pay the outstanding balance with no less than the required minimum (which will take for ever and ever). As long as you pay the minimum, you are not defaulting.

Whether or not they do that, is everybody’s guess.

I got this reply from egg card just 3 days ago, so naturally after the reply i asked for my statments and now have intent to go to court with interest added. And I have a large loan which they never threatened to close cos if they did I would just not pay it and still sue them. So they would end up an extra 9000 down on top of what they have to pay out. Heres the message i got

wow moderating is fast on this site and as the post has been merged with this one i have removed the double post of my response

I was wondering if anyone has tried to claim back charges from Egg ?

I've just been charged £16 for going £12.59 over my limit, not to mention previous charges I have had against me.

    Thanks

Even their revised £16 default charge, which seems to have satisfied the OFT?
    OFT wrote:
The OFT's presumption will be that credit card default charges that are in excess of £12 are unfair, unless there are limited, exceptional factors in play, for example where a card issuer has a policy of requiring customers to pay minimum monthly repayments by direct debits, such as that operated by Egg, and offers credit cards only to customers that satisfy a relatively high scoring requirement.

Unless my Maths has deserted me, £16 is more than £12! :p
