Thanks for your help, I'll take on board what you've said.
I spent 2 weeks reading through threads and know the process I need to go through and what I need to do at each stage. However, when I'm faced with a letter trying to 'throw me off track' so to speak (which of course is inevitable) then I want to make sure that what I'm putting forward will suffice enough to continue the claim. I've posted what has stumped me a little on this forum as I needed help. Obviously there are people that have already been through this process, like yourself, and of course you can pass on your knowledge to others.

This is only my opinion as well but I wouldnt worry about the counterclaim, you've got an agreement setup to pay as much as you can afford each month. If this ever was to get in front of a judge, he/she is not going to make you pay more than you can afford so Egg would just be wasting there time and they would know that. Doubt they would ever take it that far, it's just scare tactics.
Plus the fact that they are being retaliatory to your claim for charges and counterclaiming can only work in your favour.0 -
Has anyone had any problems with egg trying to prolong the 40 day process?? Their 40 days was up on Thursday, and i rang to tell them nothing recd and was advsd that they don't begin their process until they recv the extra DPA information back from me that they request. I sent this back which they recd on 1st feb. They say they will be get the list of charges to me by 18th March. I told them this wasn't acceptable but they say thats their procedure.
Any suggestions? Can I claim for charges put on my egg loan? I know that i have had several, however i don't want to send them the £10 to get the statements sent to me if i can't claim for late fees on my loan.
I'm about to send of my letter requesting my statement for my egg card so should i send two cheques one for the egg card and one for the egg loan?

Hi,
I need to claim £20 charge from with Egg but wondering whether to bother as seems Egg has been quite difficult to deal with. Should we bother with small claims like this? As can't really threaten with the courts on this amount?
If i do claim do i send to Egg Derby or elsewhere as i believe they have merged?

I've tried to claim Bank Charges from Egg and have initial rejection letter so i'll proceed to the next stage but has anyone had any sucesses with them as i've not seen many on the sucesses board?

Egg sent this to me today:
Egg does not believe that the terms and conditions of the Agreement are in any way unlawful or unfair. Egg recognises that customers sometimes exceed their Credit Limits and/or fail to make a payment and has systems and processes in place to deal with this. These include the use of computer systems, staff and other necessary costs.
The charges set out in condition 7 of the Agreement are calculated by taking into account the costs incurred by Egg in maintaining these systems and processes and dividing this sum by the estimated number of customers who will exceed their Credit Limits or fail to make payments. These charges therefore represent a genuine pre-estimate of the loss caused to Egg by customers who break the terms of their Agreement.
A genuine pre estimate...but they are still refusing to give me a breakdown of what it cost them for me to go over the limit. I tried to reply but there is something wrong with their site - again :mad: as I discovered AFTER I had typed out reply :mad: I'm not entirely convinced it's not to get back at me lol
So now I'm going to lodge a complaint with the Financial Ombudsman, as I'm not willing to accept their refusal to supply the data.
And I'm going to close as well, particularly as they have charged me 50p on a zero balance!!:( I hope I am getting on their nerves as much as they are getting on mine:pI have had many Light Bulb Moments. The trouble is someone keeps turning the bulb off

Last year between June and December I racked up some overlimit fees on my Egg CC. Some are ridiculous like £8 over charged £20, £17 over charged £16, £9 over charged £16. Would I be able to claim these charges back? If so, could I have some advice on how & when etc. Now they want to up the APR to 21.9% which is absolutely ridiculous.
I am looking to change the debt to another card I am awaiting on an application. Over the last few years I have been a bit silly and now at my maximum credit limit but come June will be snowballing with an estimated DFD of November 2009. I don’t use CC anymore.
