I got exactly the same letter as you but used the help of bectoria to send a letter to Egg accepting the amount as a partial payment, but saying I would press on with court action if they didn't refund me the full amount.

Well, I have to say thanks to bectoria as I have WON! Got a letter from Egg today saying they are offering me the full amount £652 + £133.10 interest, so £785.10 in total!

So pleased! It only took me 20 days since sending the preliminary letter and they will pay the money into my bank account as well!

Somebody can argue but I really do think it makes a difference if you are a long time customer. I've been with Egg since they first started, and I'm sure the people on here who have trouble are relatively new customers or ones who don't have the card/account anymore.

Anyway, must send the letter off and get the money!

    Cheers

well, egg finally replied to my letter (only a couple of days late) stating that I would prefer to settle out of court as they will only lose more money etc.
they have offered £160 plus £39.97 intrest - though they are still insisting that the card protection will not be refunded.

have accepted amount on the provider that they send the remaining debt back to the collections agency so I can continue payment (at the minute they have got their solicitors telling me I need to pay it all now (£689)

they also pay the charges back by BACS so no waiting for a cheque to clear.

will update again when they have replied/put money in my account!

Egg replied to my initial letter requesting statements. They have sent me a letter telling me I have three options open to me:

    Option 1:
A complete list of transactions (including charges).
This costs £5 and can be sent within 7 days.

    Option 2:
Copies of my original statements from...... to........
This costs £2 per copy (but no more than £10). This takes 14 days.

    Option 3:
    Complete Data Subject Information Request.
This costs £10 and takes 40 days.

Given that I sent them a letter demanding the statements under the DPA and I sent them a cheque for £10 I assume that I've already chosen option 3.

I take it that this is just a delaying tactic? Also, what would I have to lose by choosing option 1?

I have just re claimed £46.13 in late payment charges back from egg. Sent the second letter off asking for payment and they denied it saying they would pay the difference between what they charged me and the amount they charged now. I sent the thrid letter threatening court action. Within a week they sent me a letter saying they will pay the charges, success!!

Any advice, folks? Need to send a reply to them soon.

Got my first letter reply from EGG today - I was claiming £120 plus around £4 interest, but they only offered £8 as full and final settlement. Whats my next step? and is there a template letter I can use like with the first one?

    Cheers for any help.

Also: Will trying to reclaim charges from affect my chances of a DMP which CSSS are setting up?

    Hi

It's really up to you as I think you will get the information whatever way you go. I used the 3rd option and I got the statements well within 40 days but it seems that option 1 would be quicker and would cost less and give you all the info you wanted. As you've sent them a cheque for £10 then I suppose that if you go for option 1 then they need to give you back £5.

I suppose you posted on here as you were hoping that people would tell you the difference between the 3 lots of information but as I say I think you will get what you need from all of them so don't delay and send a letter to them telling them which one you want.

Good luck. I hope your claim was as easy as mine!

    Cheers

    Thanks for that.

It seemed weird to me that they were offering the info I asked for in a much quicker, cheaper manner than I was expecting. Thought there might have been a catch.

    Hi

I certainly don't think there are any catches, but I don't know why they don't deal with all customers the same way. I assume you used the template letter on this site for your DPA request like everyone else, but I never got the choice like you, I just got the statements sent to me.

What is stranger is that I actually got my £10 refunded as they said they didn't charge for the service!

    Cheers

    Chris
