    There is an egg thread somewhere if you do a search. If you write to accept the offer as a partial payment but will continue to court for the remainder then you will more than likely get the full amount back. I did!

    Thanks for your response. How exactly did you accept the offer as a partial payment? Did you use the form they sent you or just put it in a letter. Also, when you did this did you adapt the LBA and other letters to reflect the fact you had taken the partial payment?

  • I successfully claimed £300 + 8% interest + court fee a few weeks ago for credit card fees.

    I started the process, got the usual fob-off letter then proceeded to MCOL. I rejected an offer of 100% + court fee (no interest) by sending an email to their solicitors (Evershedds) - they then sent me the full amount (+interest) a few days later.

    Hope this helps. I really wouldn't worry about going for the full amount providing you've done everything correctly

    How difficult are people finding Egg?

    Hi Chris

    To accept a partial payment I sent this -

    We refer to default charges applied to our account amounting to £, which we have requested you pay back.
    We wrote to you on 2nd March 2007, making the original request for a payment in settlement of our claim. We cannot accept your offer of £ as full and final settlement of our claim, however, we will accept this as partial payment but will only accept an offer of the full claim amount. If we do not receive this we intend to claim the full amount together with interest up to the date of judgment and court fees in the proceedings through the county court.
    This is based on the Unfair Terms in Consumer Contracts Regulations, as we believe these default charges are unfair and not proportionate to your costs, and therefore the Northampton County Court will rule in our favour.
    We have attached a full schedule of the charges with this document.
    We look forward for a full response to this letter within fourteen days, otherwise we will commence court proceedings to reclaim our money.

    Is there any way of asking for the bank statements for free by email. Costing me a fortune. Probably my fault though-did not think this through whn I instigated all these claims at the same time!!!!!!!!

    Hi there, I have written to egg asking for £982 back in charges, but they have written back saying all their charges are legal and that they were held up as an example following the big enquiry that was carried out, as to how banks should conduct themselves. They say that £16 was set as a fair charge, and that they are offering me £4 for every time I was charged in my five years I had the card. This amounts to only £160, and I'm wondering if they are right in saying I will win no more?

    Can anyone help? I can't find much on them and wonder if they are the ones who are in the right?!

  • It sounds like a delaying tactic to me.
    I'd press on with the next template letter demanding the full amount.

    Thanks, I saw knew that they would write back and say that it was lawful, but it was very convincing!
