    I've been Money Tipped!
    40 (working) days up today with the Halifax. Phoned them and was told "nothing on system to say being dealt with, but would request today, and could take another 40 days".
    Also told that we'd sent to incorrect Dept. (and address?), so could be 'missing' ?
    Stated that we have waited 40 days already, and Postal Order had been cashed (although this was a Bluff...not sure if it has or not?!) and that we were only willing to wait another 7 days, then we would report to ICO.

    Anyone Advise to do anything differently? Or is this OK?

    Hi.
    Basically, I just wanted to know what I could do about not having received the 6 years worth of bank statments I paid Nationwide for on the 20th December 2006. Although my proceedings against the bank has gone as far as sending in the baliffs, (by estimating with the statements I had), out of principal, I would still like to receive the 6 years worth of statements that I paid ten pounds to receive.
    Nationwide have simply listed all of the charges on a table and sent that to me. Please tell me if there is anything I can do as they failed to comply with the 40 days they were allowed. Im assuming they are in breach of the Data Protection Act/Freedom of information- Im no legal expert!

    In all of my correspondence with nationwide, I mentioned that I have still not received my statements.

    I'm not sure you are entitled to your full statements actually. I've just copied this extract from Martin's template letter;

    I understand that statements on their own are not covered by the Data Protection Act 1998, yet I’m not requesting the statements per se, but the charges, which I’m entitled to by law

    Which does seem to suggest that you can request the info on the charges which they do have to reply too, but that they are not required by the data protection act to supply you with the statements themselves. I guess most banks just provide statements since it saves them the hassle of calculating the charges themselves!

    I'm no legal expert either - I'm just surmising from the statement from the template letter.

    hi all ... recieved letter from bank of scotland ..' i am sorry to advise you that i'm declining your complaint' ... the thing is i have not complained i've only asked for a list of my charges , how hopeless are these so called proffesionals and I still dont have a list of charges.The fo has written to them also for my list,but still no joy..i think the dont know thier !!!! from thier elbow...cheers Dave.

    we are up 87 days with nothing other than a letter from Yorkshire bank thanking us for our patience, i reported them to ICO and still had nothing, i think i am actually going mad, as i do not know what else to do. can anyone advise me please?

  • Hi,The Halifax cashed the £10 cheque but so far have not provided the 6 years worth of statements.It's been 2 months now does it normally take this long for them to reply,Any advice would be welcome,Thanks:rotfl:

    no it shouldn't take this long for them to send you the information you have paid for. You should contact your bank and give them a "gentle" reminder that they have taken your money and they have not provided the service you have paid for.
  • Well 40 days were up last thursday (da 10th) so on tuesday i sent the next letter saying if they dont respond withing 7 days etc. sent it recorded and on thursday my statements from natwest arrived! thought it was going to be around £200 from them, turns out to be £595! the account was only open for 14 months! in complete shock right now. No reply so far from Barclays though. Cant begin to imagine how much that'll be!!!

  • I wrote to the Nationwide Requesting details of my bank charges on the 22/01/07, I sent them 2 checks for two flex accounts, on the 15th of March they cashed one check and returned the other with a letter stating that they were not going to proceed with my request as I had requested the information incorrectly (yet still cashed one check), apparently I should have only sent 1 check for 10 pounds and not two. I have phoned them on numerous occasions but they either put the phone down, forward my to the wrong number and most recently given me the number of the data protection office which is a permanent answering machine.

    This is now well over 40 days and in breach, could anyone please tell me were I stand with this.

    Write them a letter informing them that they haven't met their obligations under the Data Protection Act. Accordingly you are giving them a further 7 days to comply or you will make a formal complaint to the Information Commissioner.

    Just as a point of reference, what was the wording you used in your SAR?
