    i sent the first letter giving them 40 days and nothing so i sent a second letter giving them a further 7 days which i got from here threatening to report them
  • Hi, does anybody know a phone number for the Halifax Data Protection Manager as i sent of my letter for statements and they signed for it on 04/04/2007 but i have had no response and they haven't cashed my cheque!

    Will they tell me that 40 days start from cashing the cheque? In my mind its up to them to get their finger out and stick to the legal time frames, that's why they are in place.

    Any suggestions are gratefully accepted

    Hi snap2000, thats right, didnt know about the 1st letter you sent until you just said lol

    What bank are you with? i am with Abbey, i wait 78days for my statements and i found emailing them done the trick in getting my statements in the end!!!!

    If you haven't received the statements within 14 days of them receiving your request (your extra 7 days will have more than covered any delivery time), then report them to the Information Commissioner. (If I refer any more people to him, he is going to be sending "the boys" around!)

    I have my doubts about the effectiveness of "e-mail bombing".
    The acquisition of wealth is no longer the driving force in my life. :)

    I just recieved this letter from my bank

    Within the terms of the Data Protection Act we have 40 days in which to provide you with the information we hold. The end of this time period has almost been reached, however due to the high volume of requests we have received in relation this high profile issue I regret that we are not yet able to provide the information requested

    Whilst you are within your rights to refer the matter to the Information Commissioner at the end of the 40 day period, I confirm that we shall provide you with the information as soon as we possibly can.


    What do you think should I wait or are they just stalling?

    well i decided i would try and claim back some charges (minimal but hey it all adds up!)
    Well i have filed with MCOL with capital one. husbands Halifax had the 'we will take you to court' letter..still have 7 days left to respond..
    But my problem is Hlaifax bank. I asked for statements about 1 month ago but have heard nothing :confused: They won't help on the phone and the branch said i have to do a copy of my letter, take it to them and try again, as they have a certain amount of time to respond.
    Is this right? what should i be doing?
    i have a sleeping baby on me now but i think the request for charges amounts was on about the 13th April.
    What should i be doing?

    Nothing I'm afraid this is the time consuming part, so long as you used the template letter ( S.A.R ) on this site and you requested the list of charges under the D.P.A and enclosed a tenner then they have 40 calender days to supply you with this information....

    Also did you send it registered post so you know and can prove they have recieved it, if so and nothing after 40 days then report them to the information commission...
