40 Days up and nothing....(merged)

Hi, I have sent my letter to A & L, today is 40 days since posting, so we had received nothing back, we called the bank a few minutes ago and they advise that there has been such a backlog that we will get a reply in due course, we sent a crossed postal order written out direct to A & L because knowing them, they would probably bounce the cheque!!.
They advise that they cannot tell me when the postal order was cashed, that no correspondence is showing on our account and that the 40 days legally starts from when they cash the postal order not from when it is sent.
Can anyone help with this, are they correct in what they are saying? should I just still send the letter telling them that because they haven't replied they have broken the dpa act and give them 7 days to reply? or should I just keep waiting? please advise as I was thinking of sending the next letter about dpa anyway? dolphin92940 -

Is this the correct address for natwest customers. if so where do i find the number to call them for information as to where my bank statments are!.
Also dose anyone know how i can check if they have cashed my postal order.

Thats been the address since 15 April. I wouldn't bother ringing them - it won't get you anywhere - if you do, I'll bet that they will just say that they've never received it.
They've had their 40 days, so report the matter to the Information Commissioner.
I can't advise about the postal order.The acquisition of wealth is no longer the driving force in my life.0 -
Hi dolphin9294, i would suggest sending the next letter yes otherwise they are more then likely to just ignore your claim unless you persit!!
Otherwise if they still do not responed with your requested statements report them to the IC.
I found emailing them helped to speed up with my requested statements as they know your not going t give up.

Thank you so much for replying, I think I will send the letter, just need to know the total of the charges so I can proceed but didn't know if they were correct in saying it was 40 days from cleared payment, also suppose that as I sent a postal order and not a cheque maybe I should start the six week process via post office to find out if it has been cashed but was trying to avoid that. I have got a lot of statements at home here but haven't checked to see if I have all six years, thought it would be easier and more official if I did it the correct way.
Thanks again, will send letter tomorrow and see how I get on, knowing my luck I will probably be the only one that isn't successful.

They actually have 40 days from the date they receive the request.
If you didn't send the request by Recorded Delivery, so don't know exactly when (or even if) they got it, I suggest adding 5 days from the date you sent it. My reason for this is that the court will allow 5 days from serving your court claim before "deeming" that it must have been served. Therefore, if you also do this, no-one can say you haven't given them enough time!
If you still don't get your statements, report it to the Information Commissioner.

Looking for input. Come mon 21st, it will be 40 days since sent 1st letter to Lloyds TSB bank with £10, requesting statements. Have heard nothing. What do I do on Monday?
Do I phone bank? Then what?
How successfull has TSB been at paying out?

Thanks for your response, I just thought that if they are saying that there is no sign of it on their computer then they are likely to try and deny all knowledge or drag their feet even longer, that is why I was considering sending the letter anyway, the letter I was going to send wasn't the one requesting the amount as realise I cannot do this until figures arrive, it was another letter shown in one of these messages, one stating that by not responding or issuing my statements, they are broken the data protection act and that it is my right to have these figures, it also gives them 7 days to reply or I would go to information commissioner, I just feel that there is no way a letter sent to them on 5th april would not even be showing on their system and that they are probably trying to ignore me, hoping I will go away, no chance!!

I know exactly what you mean - if it wasnt for these guys and girls on this site there is know way i would be able to reclaim my charges!!!
