    I had an idea - seeing that there is no guarantee that Im going to get these statements from Barclaycard as part of the Data Protection Act...what if I order the statements for 2002, 2003 and 2004 over the phone?

    And when I make my claim add the £72 or so that its going to cost me to do this into my claim against barclaycard - and state that Barclay's were going to take 4 months to send them IF I WAS LUCKY (and thats even if they sent them as they refute the Data Protection Act - as clearly stated in my letter from them "...as these records are stored on microfiche we at Barclaycard do not believe they are accessable under the Data Protection Act 1998.). Quite arrogant of them Id say to refute an entire ACT. 'Oh..we dont think we subscribe to that Act so we're just going to ignore it'. Thats unlawful behaviour is it not? Im surprised they're actually still operating -Trading Standards anyone?!??!?).

    I reckon legally I should be entitled to claim the fee back on ordering my statements. If they have them accessable to customers ordering them for £3 a pop over the phone then they sure as heck should have them accessible as part of the Data Protection Act.

    Anyone else have an educated opinion on this?

    Having read lots of the threads posted here someone must have a template letter for sending another letter after the 40 days + 7 days letters have been posted and the complaints lodged with ICO. What happens next has anyone had any success after this. How much longer should I wait. Please help

    hi, i did eventully get my statements , i just kept ringing them..
    still thobbing me off the with the usual letters saying they believe there charges to be fare..etc
    so only 6days left now before i start court proceedings..

    Hello everyone.
    I wrote to HSBC asking for a copy of all my statements going back 6 years...popped a cheque in to cover costs etc, took a walk down to my branch one lunch time and popped it in the letterbox in the bank. Waited...and waited....and waited. Now been 40 days so gave them a polite telephone call to chase up my request.....they say they have never had a letter from me!!! Now they say they have noted my request which will take
    40+ days due to the volume of people making this request??? I insisted that they have had my letter....they insist they have not and I will have to wait.
    Any advice would be appreciated.

    Wrote to TSB credit card best part of 2 months ago requesting charges. No reply at all. Should I resend original request or do I complain to ombudsman? Unless I can get them to communicate I guess that I am a bit stuck.

    Just joined today and need some advice...
    Sent letter to bank of scotland to for list of charges from two accounts along with two £10 pound cheques. 12 weeks have passed and the cashed the cheques 4 weeks ago , i rang them to find out what their excuse is ... ' we have an eight week back log of customers claiming ' was the reply .... I was wondering if anyone else has heard of this or is it just a stalling ploy... any info would help .. cheers ..Dave..

    Also check if you can download your statements online as you can with Lloyds and HSBC.
  • I received my statements back from NatWest two days after the 40 day limit. I think they would argue that they kept the 40 day deadline as they obviously posted the statements to me on the exact 40 day limit. I have a question now though. The statements are up to July 22 2006. I can get statements online from 4 December to 5 May. Does anyone know why they might have omitted sending statements from July 22nd to December 4th? Is it a clever ruse on their part to delay dealing with my claim because there is some new ruling coming out soon or something? What letter do I write to them now to get them to send the missing statements?
  • I sent my cheque off for £10 to Lloyds TSB over 40 days ago, to cover the charge for copies of my credit card statements for the last 6 years. I've had no response and they haven't cashed the cheque!! I'm not sure where to go from here.

    What do I do now?

    Please help.
