I too am in a muddle as to what to do. Can someone please give me advise.
I sent off my 1st letter to two different banks, Natwest and Barclays. Someone stole my Natwest cheque book so had to cancel all the unused cheques including the one I had just sent to Natwest asking for my back dated statements. Do I start again , the time period is now up and I have had no responce, to make matters worse I sent both these 1st letters with cheques to the branch where I had opened the accounts!! no replies yet!! are the letters lost? should I start again?
I feel brave enough to start again.

The only advice I can offer is send the letter by Rex_Mundi, linked previously in this thread and keep badgering your bank daily until you get the statements.
Do report to the ICO as well.
Speak to your local branch, the bank's complaints/customer service department and their head office, I would do this daily until you find someone who will deal with your request for the information/statements.

I've had to complain to the Information Commissioner about both MBNA and Marbles.
The 40 days was up on both of them last week and i cant a response from either company.
I guess its just a waiting game now as god knows how long it will take for the busy Info Comm. I received my copy Statements from Barclays very quickly. I suspect that
they are inundated now with thousands of us trying to reclaim charges and
more than likely, just like the phone system, they have probably assigned a
couple of juniors to do all the work/copying. They will probably increase
their charges to accomodate the expense of all this extra work!0 -
I requested my bank statements from LloydsTSB and they told me it would take up to 40 days to get them to me. After calling them after the 40 days were up they are now telling me its 40 working days which is not what they said when I requested them. Could someone tell me if the 40 day law is working days or normal days.0

I am helping my mum start the process of claiming back charges from Halifax. 40 working days will be up tomorrow and we have heard nothing from Halifax.
What is the next step, I understand mum should phone the Halifax, but does she phone the branch we sent the letter to? Does anyone have a sample letter giving them another 7 days before we report them for the breach of not replying?
We have never done anything like this before, so any advise would be greatly received.

Please help me if you can?
On the 9th of January 2007 I sent the Clydesdale bank a request to claim back unfair bank charges, I had no reply. On the 22nd February I phoned the bank and they told me they didn't receive the letter, so, I sent a copy the same day. http://img.moneysavingexpert.com/smi...smiley-030.gif

This time I handed another copy into a branch for them to forward to my own branch(I couldn't get there myself). Hurray! strangely enough, they did receive this letter.http://img.moneysavingexpert.com/smilies/wink.gif
YESTERDAY I PHONED THE BANK AND THEY TOLD ME THAT THEY COULDN'T HELP, IT WAS ANOTHER DEPARTMENT AND THEY DON'T COMMUNICATE ON THE PHONE, ONLY BY LETTER. PLEASE ADVISE ME WHAT I CAN DO (IF POSSIBLE)? http://img.moneysavingexpert.com/smilies/wink.gif
Yesterday I received a letter which says: -
Re: Data Protection Act 1998 - data Subject Access Request
I refer to our previous correspondence acknowledging receipt of your request for details of charges and/or statements relating to your bank acc.
Within the terms of the data protection act 1998 we have 40 days in which to provide you with the info we hold. The end of this time period has almost been reached, however, due to the high volume of requests we've received in relation to this high profile issue, I regret that we're not yet able to provide you with the info. requested.
Whilst you are within your rights to refer the matter to the Information Commissioner at the end of the 40 day period, I confirm that we shall provide you with info. as soon as we possibly can.
I thank you for your continued patience and understanding in this matter.

I would tell them that you intend to report them to the information commisioner if they do not furnish you with the list of charges by the end of the week .
They are LEGALLY obliged to provide this information within 40 days and by not doing so are breaking the law .
I would go ahead and report them anyway , youre within your rights to do so
