I finally got my statements through from Barclays but only from July 2002.
I phoned them and requested they send out the statements from 2001 and was told it would another 40 days!
So say I get all the statements by end of May or something does that mean I can only ask for refund of charges applied from May 2001 and not from February as that is when I requested the statements?If you're going to stalk me, while you're at it can you cut the grass, feed the dog & make sure I've got bread & milk in0 -
If a bank takes longer than 40 (calendar) days to get the information to you, you must first inform the IC, then take legal action through the courts for failure to comply with the DPA.
Simple. And very effective. They REALLY don't like that one, as their head data controller has committed a criminal offence - in once case against CITI, the judge asked the claimant if he knew the name of the head of the DP dept. He didn't.
The judge replied that it was a pity, and that if he were there, he would have considered handing down a custodial sentence.
They don't like it up 'em!0 -
....or, of course (and this is not something I have come across), you could just estimate the charges - say up to 5k.
If it is queried, you cannot reasonably be expected to have provided correct information surely as the bank, through a direct breaking of the law, has prevented you from making an accurate claim.0 -
I wrote to my bank on the 7th March asking about my bank charges, i still have not recieved the information, what i would like to know is the 40days working days or just 40 days in which case i can contact them now. I know they received my request because i checked 2 weeks ago. Thanks Breidge0

40 consecutive days bank will try 40 days working days as far as im aware0 -
i sent the first letter to lloyds tsb 42 days ago and still havent had a reply has this happened to u and if so did they ever reply
Received a letter 4 weeks later to tell her that they had received her letter and the normal rubbish about banks having to charge for the service but said they would forward her statements within 3 weeks that was on end of march0 -

Please forgive me if i have posted this is the wrong place as i've never done this before. I need anyones help with my reclaiming situation.
I am struggling with Lloyds TSB at the moment. I sent my first letter to them on 2nd March 2007 asking for a detailed list of my charges (basically the template letter). I got a response from them 12th March saying that they are "sorry to learn that i had the cause to complain". They claimed that the would need to look into this and this would take 2 weeks. 20th March I receive a letter stating the charges were fair (blah blah blah) but they would send me my list of charges within three weeks. This passed....nothing :mad: . I sent them a letter on 13th April stating that they have broken their promise and that I will give them another 14 days to send them to me. 14 days is TOMORROW! as much as i love fighting them, i dont actually know where to go from here. any help would be greatfully recieved. as you can see from my user name, i'm a uni student and any cash right now would be a god send!!

Hi troubled-student, I'm in the same boat as you trying to get my list of charges, your next step is fill this letter in, it's to the Information Commissioners Office and send it to the address at the bottom with a copy of all the letters you sent the bank and they sent to you. I have filled this in and i'm going to post it on Monday. I give my bank 50 day's then another 7 days and there up on Monday.
