    40 days have passed since I requested information from Bank of Scotland Card Services, so I rang their complaints office. Response from them was that they'd been inundated with these requests and there was a backlog. I told them they'd breached my rights under the DPA. Unbelievably, I was advised that in that case all they could suggest was that I made a complaint to the Information Commissioner, which is exactly what I've done! Fairly easy to do online, however I'm sceptical as to what good it might do!!!

    Halifax have (after my initial request in Feb) sent me a list of charges applied to my accounts. The problem is that they only date back to last year and I'm sure there are more. How can I find out if I can't see the statements? I don't want to threaten court and they then tell me those are all the charges (although I'm 90% it can't be just that!).........

    I wonder if anyone can help. I contacted Yorkshire Bank 28th March with the Request For Info form from this site & they wrote to confirm reciept & acknowledged my £10 fee. They have now written on 23rd April to say they cant provide me with the info under the Data protection Act within the 40 days due to "the high volume of requests received in relation to this high profile issue". They have tehn written to me on the 27th April requesting me to "clear the outstanding overdraft balance .. or this will leave us little alternative but to refer your account to the Collections Centre". The O/D is £2500 and I reckon theyve charged over £10K in fees in the last 6 years. I wonder if anyone else has had a similar experience & can advise me what I should do next??

    Also check if you can access your statements online as you can with Lloyds and HSBC.

    I am helping my daughter to try and claim back some of her Halifax bank charges I sent the 1st letter by recorded delivery on 16th march asking too see how much bank charges she had paid I never got a reply, I sent a second letter also recorded on 24th of April and up to now nothing I am at a loss as what to do next can anyone please advise me.

  • Hi people, this is my first post although I've been using the website for ages, but now I need some help.
    I sent off letters to my 3 banks about 3 weeks ago using the template on moneysavingexpert.com requesting a list of my charges.
    So far I've heard nothing and the cheques I sent with them have not been cashed.
    Should I resend them registered post, or should I hang on.
    For all I know the letters could have been shredded by now.
    Please help.

    If you have not received reply to a request for statements in 40 days, report the bank or credit card company involved to the Information Commissioner.

    A lot of banks are trying to make out that they have 40 days from them cashing the cheque - b*ll*cks! They have 40 days from receiving the request, which is why these should be sent by a method that records this.
    The acquisition of wealth is no longer the driving force in my life. :)

    If you haven't received statements by 40 days after the date, on which the bank or credit card company involved received your request, report the matter to the Information Commissioner.

    If you haven't received a reply to the "claim" letter within 14 days, send the "threatening court" letter.

    If you haven't received a reply to the "threatening court" letter within 14 days, start court proceedings.

    I think that you should call them - they'll be able to see whether they've received your letters on their system.

    I called Halifax to check and - of course - they didn't have anything on my file (hadn't sent registered post) but she was able to order them then and there, free of charge. They'll be here in another couple of weeks.... apparently (hmmm) :rolleyes:

    So it's not just me then I think they are deliberatley delaying tactics but I will wait until Tuesday by then the 14 days will be up from sending my second letter then I think I will try and phone them but I will not give up.

    Does anyone have the address to send to theInformation Commissioner I somehow dont think I will hear from them even though they have cashed the £10 cheque for the fee weeks ago.
