    Always check if you can download statements with online banking and/or camp outside your local bank :)

    As you can't complain until the 40 days are up, either phone or send the above letter to the bank first.
  • My situation is that I have sent off for my statements over 40 days ago . Two weeks ago I recieved from 2000 to 2001 , I phoned and asked them where the last 6 years was and was told that they should arrive shortly , nothing has arrived for a week so I later then phoned up 5 days later and was told they would "call me back" , I didnt recieve a phone call and called them up again , they said that the statements are being re ordered and yesterday , guess what arrives... 2000 to 2001 again. So i made yet another phonecall and was told that they will be arriving . I cant see them sending them EVER!.

    My account isnt in very good shape , being a student im £600 over drawn and have recently stopped re paying my loan I got when I was 18 for £3000 . Im now 23 and still owe £2200 Ive decided not to make any more payments of the 100 a month as I know im not soley paying intrest. They told me that there going to DEFAULT my account ... Do you think this is effecting my bank charges ? and When they do DEFAULT it will it mean I will be unable to claim the charges back.

    Any help much appreicated .

  • 40 days are up so i sent the 7 day warning before i complained to the imformation commisioner. Those 7 days are up and so far i have
    a) barclays, letter after 2 days of initial letter saying it may take several weeks
    b) 2 years from barclaycard saying it will take another several weeks for the rest.
    c) nothing whatso ever from cetelem/aura/dixons ( these guys were ruthless in charging me calling several times a day multiple letters and upto 3 txts a day )these guys will never give me the info i need.

    so i complain to the IC, what happens now?

  • Hi All, this is my first time on this chat forum, have looked at several threads, but can't find a similar request, so if I am asking the same questions as many others - my apologies in advance!

    I have started the process of trying to reclaim my charges from the Halifax. I sent my letter (as per template) on 8 March along with my cheque for £10. They eventually cashed it on 10 April! By my calculation the 40 days were up on 17 April and I had heard nothing. Now it is the 22 April (all be it a Sunday!) and I still have not received my statements or any communication, therefore can anyone advise what is my best course of action now.

    Many thanks for any help you can offer.

    Have Just Recived All My Money Back. They Were Abit Over With My First Letter To , So I Wrote To Them Stating That If I Have No Reply Within 7 Days I Shall Report To The Information Commissioner . 3days Later I Got Got My Reply,[ Your The Boss ] Dont Change It To Go Their Way, Stick To Your Deadlines. Then They Know You Mean Buisness. Good Luck .

  • I sent my SAR on 02/04/07 and received a letter back from Barclays data protection department on the 12/04/07 with my cheque for £10 stapled to it. The letter says: We refer to your recent letter, which was passed to this department as we deal with requests for information under the data protection act. We will be sending you copy bank statements for the period requested in the next weeks (without charge). Please be aware that statement information prior to 2000 is stored manually rather than on computer. Therefore, if your account was opened prior to this time, there may be an increase in the time required to collate the information you have requested. I apologise in advance should this delay be the cause of any inconvenience to you. Nevertheless we will supply you with the statements as requested witin the statutory 40 day time period. We do not maintain a list of charges on each customers account. However, the charges information you have requested can be obtained from the copy statements. As the bank is providing the copy statements on a complimentary basis your payment is returned herewith.

    I think this letter is probably a standard letter that is sent to everyone but i received this quite quickly from what i expected so hopefully the whole process will be dealt with in the same way. Has anyone else had this letter and managed to settle their claim? If so, how long from start to finish and should i give barclays the full 40 days to send my statements or should i wait a couple of weeks and send them a letter reminding them of their obligations under the DPA? I will keep posting my progress as it happens.:confused:

    I have given barclays 40 days to send me list of charges on my credit card but the deadline was last friday and i havn`t heard anything.
    The templates i can oly find is asking for the charges to be paid back but i don`t know what these will be.
    How should i word the letter?

    I have received statements for last 18 months and a week later a print off of charges paid until jan 04 with a letter offering their apologies for taking so long in sending it
    *I apologise for the delay in sending you all the iformation you requested.Thank you for your patience.we are working very hard to provide customers with the information requested on a timely basis by introducing new processes and systems.In view of the delay,we will refund your account with the £10 original fee charged.Alternatively,if your account is now closed,we will send you a cheque.*
    Do i wait for them to send me the previous years or do i threaten to take them to court?
    it looks like they are trying to delay it to me.
