  • Contacted Barclaycard today as I wrote to them (on my sister's behalf) on 15/2/07. Cheque was cashed on 8/3/07 - 40 days now way over!!! Got my sister to ring them and they stated "We're so inundated at the moment, it may take up to 90 days". My question is this:-

    Why cash the cheque then if you can't deliver the goods in a timely manner?

    This whole matter makes me smile so much. I think I'll file a complaint anyway to the information commissioner. If the boot was on the other foot and Barclaycard gave us xx days to do something I wonder what would happen if we were late.

    I feel we should also be able to charge for follow up letters and telephone calls, just like the banks do! How would they like it if WE added £30 for every letter we send?

    I also would like to know whether or not i should complain to Information Commissioner...

    I sent a letter requesting a list of all my bank charges to Ulster Bank re a student account I used to hold with them but is now closed.
    They have replied stating that as my account is closed they cannot access my records without further information - namely the date on which the account was closed.
    Unfortunately I cant remember and dont seem to have recorded it anywhere, I think that I closed the account in December 2005 but dont know whether to just get in contact with them to tell them this.
    It seems hard to believe that even with my name, address, and account number that they cannot access my old account details...

    Any advice would be greatly appreciated!
  • I,m With Yorkshire Bank, The 40 Day Deadline To Respond Has Passed, I Recieved Conformation Letter. But They Said They Having So Many Claims Will Take Them Longer. Any Advice On How To Speed Things Up Would Be Most Appreciated

    Do you mean the 40 days to supply you with your bank statements? You have every right to report them to the Information Commissioner now, as they are required by law to supply the info within 40 days.

    Hiya - I've read the majority of this thread (still working my way through it) and was wondering if anyone could give me some advice please...

    I sent off the first letter dated March 9 (but think it was actually posted on the Sat) giving Nationwide 40 days notice that I wanted a note of the last 5 (Scotland) years of bank charges. 40 days will be up this Thu but for some reason, I got it into my head that it would be yesterday so have printed off another letter to "hurry them up a bit" and dated it Tue 17 April.

    Should I give them until Thu to respond or do you think I should just send off this letter? I would call them up but not too sure if the local branch would be able to help any, or would they be able to get me a head office number to call? Plus not very confident on the phone - I'd probably just rant and rave at them and end up getting nowhere.

    They cashed my cheque to cover the costs of sending out the information, so as far as I'm concerned just now, they have comitted fraud by not keeping up their end of the bargain. I can access about 18 months worth of charges online and in that time alone it's quite a substantial amount so I wouldn't like to take a guess at what it'll be over the last 5 years!

    Sorry for asking all these questions, just would rather do this on my own than pay for one of these companies that charge you on a no win no fee basis.

    I sent a letter and £10 cheque on the Fri 9 March, 2007 requesting five years of bank statements as is my right under the Data Protection Act. I have been expecting copies of my statements within the 40 days stipulated under the Data Protection Act. As yet I have not received any correspondence from you.
    By not supplying the information I requested, you have breached my rights under the Data Protection Act. You leave me with no alternative that if I do not receive copies of my bank statements within the next seven days, I will forward copies of my requests to the Information Commissioner.

    I look forward to your timely response.

    Find enclosed a copy of my original letter.

    I have written to a number of credit card companies for my statements.
    From most I have received a part batch of statements with a letter saying the rest will follow...The 40 days are up now for them all, and those that said the rest will follow have all failed to send them by the 40 days. Should I give them an extra week or should i report them to the Information commisioner?
    A telephone call is not really an option as I live in Germany at a BFPO (British Forces Post Office) address.
    I am preparing the letter for the Info geezer while I await your response/s
  • have just received bank statements after waiting 52 days, do i mention in my next letter it should have been 40 days to reply and where do i send my next letter asking for my money back to i send it the address i first wrote to asking for my statements or to my local branch . im with hsbc

  • I have received 13 seperate letters for my bank charges for the last 13 months, I rang Abby up to ask was this neccessary to send them like this, and no wonder the banks are charging excessive charges, they said that this was the way that they did it. I have'nt received anything since, so I need the previous 5 year statements which they said they will send within the next few weeks. Does this mean that I am going to be inundated with about 65 letters through my letterbox!!! My postman will be pleased !!!! What do I do about waiting for the 5 years previous, as they are taking so long to send them to me. Answers please (if any)!!!! Thank you
  • Can anyone help i sent first letter to Lloyds about the 20 feb.had a letter back on the 13 march. saying sorry you feel need to complain, and my complaint will be completed within the next two weeks.Then on the 26 march a letter saying copy statements will be sent within 3 weeks.Time is up again it has gone 3 weeks. So i have been phoneing for 4 days and cant get hold of anyone.It is now about 58 days from the first letter. [HELP WHAT NEXT.]

    Im a newbie and trying to reclaim bank charges on 3 accounts, two of which are closed.

    Im with the Halifax..... I wrote to them with my £10 cheque on 20th Feb asking for all my statements on the accounts. The 40 days came and went, they cashed my cheque on April 2nd but no statements arrived.

    So I sent them a letter on day 47 (8th April) saying theat they had 7 days to send them or I would report them as being in breach of the data protection act.

    Its now day 57 and I have had no response to either letter.

    What do I do now? Im seriously thinking of sending them 3 Small claims court summons for £7000 each....

    Please help as its stelemate!
