40 Days up and nothing....(merged)

Hi everyone,
I sent my first letter to halifax requesting charge info on 28th Feb the 40 ndays gave them until 9th April to respond sent the letter recorded and it was signed for on 1st march. Nothing at all arrived so I phoned them on Thursday last week they denied receipt of my letter I told them I have seen the signiture online the guy said he would request the info but it could take six weeks to arrive here on Saturday morning a letter arrived from them my account number but the list of charges they sent were not mine different roll number the phone number on the letter is never answered so I cant get in touch I rang the banking number but they said this could take a further couple of weeks to come out to me what can I do about this dont know whether to make a complaint what to put in the complaint if it will help at all anyway any advice would be greatly appreciated Thanks Amanda x:j:love: Getting married to the man of my dreams 5th November 2011:j

I posted my letter requesting my list of charges on 12/03/2007. I enclosed the cheque for £10.00. My neighbour had to write the cheque for me as I don't have a cheque book but I wrote that in the letter to nationwide.
They cashed the cheque on 23/03/07 but so far I have not received my list of charges. I have worked out 40 days from 12/3 is 20/04/07 and I should receive by then. I am unsure what to do if they don't turn up by 20/04. Am I right in taking the 40 days from when I posted the letter? What do I do if they don't turn up by friday, the deadline? I estimate the amount to be £960 without interest but obviously need the dpa stuff to be sure!
I keep getting threatening letters from Nationwides solicitors who reckon they are going to take me to court to get the some of the charges back that I refused to pay.
Any help or advice appreciated0 -

You can safely take the 40 days from the date they cashed the cheque. If they do not turn up 40 days from then you can complain to the Information Commissioner for the breach of your entitlement under the Data Protection Act. As regards Nationwide's solicitors write and inform them that all charges on the account for the past 6 years are subject to ongoing dispute and pending court action. That should shut them up0 -

thanks, its just so frustrating with all the waiting around. they just try to fob you off all the time. they certainly deploy scare tactics!0 -
Is the 40 days up? If so, first thing to do would be to write to the IC.
A legal letter is deemed served 4 days after it is sent - the only proof for a county court that it has been sent is the fact that it has been (if you catch my drift) - the CPR states that it does not need to be recorded (although never a bad idea).
Did you send a cheque for the SAR? If so, was it cashed? Clearly if it was cashed then they cannot claim that they haven't received it.
Personally, I would get very, very angry at them and threaten court action for non DPA complience (as well as actually reporting them to the IC directly now for non-complience) unless you receive what you asked for within the next 5-7 days - they have had more than is reasonable and more than allowed under the DPA.0 -
I sent my first letter asking for statements a month ago and spoke to them today and, as expected, they have denied receiving it. Yeah right!!!!
So, back to square one because they chose to lie! I HATE LIARS!!!!!! :mad:

All written dealings with whoever your dealing with should be recorded/registered then you can see exactly when they received it and use it against them next time.

help claiming bank charges have ssent letter....and heard nothing rang the bank several times they say they have sent statements 3 times ...have told them i would report them to information commissioner and they say do so they will tell u we have sent them WHAT do i do now any advice would be helpful thanx susie0

Ask them to send you proof that they've sent the information/statements out, failing that get them to send you statements via registered/recorded post so you have to sign for them.

can ne1 help me i sent my letter away for statement 3 weeks ago and 2 weeks agao they sent my cheque back with a compliment slip saying cheque returned no payment needed and i havent heard anything further please could someone advise what to do from here x0
