    Hi, hopefully someone can help...

    I sent my DPA request to Barclays Bank on 1st March, I received a letter back on 6th March saying I will have them within the next few weeks... by my calculations they have until this weekend to get my statements to me...

    I want to call and try and push things along, so do I ring the place I sent the DPA too, which was the Data Protection address in Knutsford, Cheshire, as advised in Help Thread, or do I call a local branch?, Head Office at Churchill Place?...

    If anyone has any useful numbers and things I can say to them that would be appreciated.

    Was there a number on the letter that they sent to you - I would ring them because it has obviously been passed to them. :)

    I sent a letter and £10 cheque on the [insert date of first request] requesting six years of bank statements as is my right under the Data Protection Act. I have been expecting copies of my statements within the 40 days stipulated under the D.P.A. As yet I have not received any correspondence from you.
    By not supplying the information I requested, you have breached my rights under the D.P.A. You leave me with no alternative that if I do not receive copies of my bank statements within the next seven days, I will forward copies of my requests to the Information Commissioner.

    I look forward to your timely response.

  • Hi all - would much appreciate some advice on the following!

    I'm reclaiming bank charges on behalf of my hubby, from Bradford and Bingley and Royal Bank of Scotland. Sent letter to B&B with £10 cheque and they sent statments within 3 days. Brilliant.
    The probs I have are with RBS. I sent a letter requesting charge list on 5th March. Had response on 21st March whereby they sent ONE statement from April 2004!!!(go figure). So I responded rather angrily, and in posh words said they were taking the mickey. On Good Friday we had a message on the answer machine from RBS (again, go figure! aren't banks shut on good friday?!) from a very polite lady saying she'd send the statements out immediately, and could we add up the charges so she could get the ball rolling blah blah.
    This morning (13th Apr) we've received a bit of a nasty letter from them saying we didn't include enough info in our letter (account no. sort code and amount we wish to claim). However in all correspondence I've written his account number, and we certainly don't know how much to claim until we receive the bloody statements!!! And also - they managed to send one statement. Why not the rest? I know these are great delaying tactics.
    The 40 days to respond is up on Monday 16th. Can I report them to information commissioner for not sending the statements, or can I only do that if I have had no response from them at all (i.e been completely ignored)?
    I don't want them to be able to keep delaying....and don't know how to stop them!
    Again, any advice appreciated

    Hi Michelle!

    I've had this with a few banks - they are so annoying aren't they :mad:

    If you look at my above post, send that letter when the 40 days are up as they have still breached your rights under the DPA.

    In the section of the letter where it says "As yet I have not received any correspondence from you." just change this to your situation saying they have only sent you 1 statement.

    If after this letter (7 days) they don't reply, get them reported. Good luck :)
  • I made an official complaint to the Information Commissioner after waiting 47 days for LloydsTSB to send me the details of charges against my account, and getting two letters from them which seemed to change my SAR into a complaint, and also made excuses why they shouldn't comply with the Act. The OIC told me that this is a tactic they have seen before (surprise, surprise!), and that there is no excuse for the delay.

    After a few more days, I received another letter from LTSB, enclosing details of some of the charges (OIC says that this is probably coincidental, as OIC is sending out "several hundred complaints a week, in batches, to most of the bigger banks").

    I have written back to LTSB, in the following form:

    Thank you for your recent communication, dated 5 April 2007, with the unclear reference which could be either 27/02 or 28/02, and the information therewith enclosed. I have made a complaint to the Information Commissioner regarding the time taken by the bank to respond to my request, and regarding the apparent attempt, by the Bank, to change my request for information under the Data Protection Act, into a complaint, which would not be subject to the forty days time limit.

    In my original letter to Lloyds TSB, dated 15 February 2007, I requested details of charges against my account for the six years prior to that date. Your letter indicates that you have sent details of charges for the six years from 1 September 2001, which is over 6 months short of the period asked for, and specified in the relevant legislation.

    I also note that the data you have sent is incomplete, in that charges appear in statements issued to me by the Bank, and in letters referring to those charges, but not in your communication.

    I have taken the advice of the Office of the Information Commissioner, and understand that the request I made in my original letter should have elicited a full response within forty days of its receipt by the Bank. I therefore expect to receive from the Bank, within one week of today's date, full details of all charges made against my account in the full six years prior to 15 February 2007. In the event that such full information is not forthcoming, I am advised, by the Office of the Information Commissioner, to revise my original complaint to that office, referred to above.

    I look forward to your timely response.

    I have received statements for my first Halifax account (still open) but the Halifax even though acknowleding my closed 2 bank accounts and promising statements by a set date, still no statements! Where do I go now??? Cheers Jay

    can i ask is it 40 working days or just 40 days? i sent letters (recorded delvery) off to the bank of scotland requesting statements for my hubby and myself, between us we requested detail for 5 accounts. we have had no contact whatsoever, but my £10 cheque was cashed on the 3rd april. i am getting ready to send further letter, but thought i would ask the above first.
