Just phoned barclaycard as I received a letter saying they will get the info to me in the 40 day legal time scale.
Some snotty customer service person said that they have 40 days from the date they sent their first reply to me. I informed her that this wasn't true and they could of sent their reply two months later and then they would still have 40 days. I am right in thinking that they have 40 days from the date i sent out my letter?
Are they just delaying things? I will be reporting them this week.0 -

They have 40 days from the date they receive your letter not from when they reply.
As you say, they could wait a month before replying!
Just stick to your timescales and get them reported0 -

I have requested my statements from Barclycard over 2 months ago and have been fed some bull about they have had a high number of requests regarding statements over the past 6 years and they can only provide statements from June 2004 til present at first as any other statements before this are on microfilm and it is taking them a while to get through everyone statements (1st come 1st serve basis!!!!). I am just wondering if anyone else is experiencing this. They also said that they have sent me a a letter on 27/3/07 (which i still haven't received)to explain it will take a further 6 weeks to send the statements before June 2004. So in total will take approximately 12 weeks for me to receive them.
Is it just me or are they taking the !!!!!! and should i report them?

hi all i wrote my letter the first one to hsbc to request my statements 38 days ago have they got 40 days to reply? or have i made that up what should i do now??Not setting myself any comp targets this year, didnt seem to work last year!!! £120.98/£2008

can anyone give advice have asked abbey for statements going back six years and enclosed tenner,they have sent back five statements and nothing more the forty days is nearly up and i have copies of statements that i have kept for a few years which show some of the charges what is my next move thanks.
I would consider complaining to the Information Commissioner once the 40 days are up or you could consider calling them. Its crap!!!! Im having a similar problem with Marbles. They recd my special delivery letter on the 7th march and are saying it was actioned on the 29th, and they are starting their 40 days from when they actioned it. I sent the first template letter requesting 6 years statements etc. the letter was sent recorded delivery and was also sent to my self and remains unopened. the letter was signed for by HSBC and after the 40 days have recieved no reply or acknowledgement. I followed the step by step guide on the main website and gave HSBC a phonecall to prompt a reply.
My call was put through to the Branch liason Department who said the letter has not been recieved as it is not shown on the computer system and there is a huge backlog of claims.
I stuck to my guns and stated the the 40 day period under the data protection act had now expired and i would be filing complaint with the Information Commision.
The HSBC responded with " i will send you the 6 years bank statements to you" . this was today.
the initial letter was signed for by an employee recognised by the bank.
and proof of signature is recorded on the royal mail website.
what do i do if i dont recieve the 6 years records soon.??

HSBC sent my statements within the 40 days (no charge) however I have now sent 2 copies of my claim letter one to head office and one to my local branch (reg post) and Im still waiting for a reply 14 days later. When I phone up they wont talk to me as this is an old account, they say I have to go into the branch.
Other people have said that if you have online banking with HSBC you can get 6 years off of there??0 -
Hi, has anybody had this problem? I recieved a letter from barclays saying they will send the information free of charge in the next few weeks. This was 60 days ago (6th Feb). After the 40 days were up I have phoned them and they replied 'we will put an urgent chase on the information'. I have phoned every week since then to the same reply. How can I make them send me the information? It just isn't happening!0

Yup this is true. HSBC online banking customers can view their full 6 years statements online. I have also seen posts where people have simply gone into their local branch and they have requested them printed off there and then and it has been done0
