    Why on earth write to your local branch?

    Under the DPA 1998 they have 40 days. However, they will say that the local branch is not where the information is stored. This is probably a red herring. Write to the head office, say you have made a subject access request and say that the clock is ticking.

    Dont back down. Write them and tell them they still only have 40 days from receipt of your first letter and attach cheque again. Tell them should they not send the info requested within this time you will report them to the Information Commissioner for a breach of the Data Protection Act. ( http://www.ico.gov.uk/ )
    Stick to YOUR timescale. Dont take ANY bull. DONT be intimidated. The law is on OUR side.

    I wrote to my local branch of HSBC and got my statements in 30 days :rolleyes: (in 72 envelopes!!!!!!!!!!:eek: )

    If you have access to your account on the internet your statements are on their so you can crack on with it yourself.:j

    :money: Applied for details of past charges to Abbey last Sept. Within 2 weeks they sent lists of transactions, tons of the stuff. Charges not specified, we had to work all that out.

    Family illness and time taken to analyse...now discovered that a huge chunks of the info is missing, 3-4 months from each of the past 5 yrs.

    :mad: Wrote to Abbey one month ago, pointing out that we had paid for the info and had not recieved it all. No response at all. Is the next step to write to the information commisioner??

    I cannot proceed until I have this info (cannot accurately calculate the total charges). Or, should I write to the Abbey again. Don't believe in doing anything over the phone.

    Is writing to the info commisioner going to cause big delay?? Any one know where they are based please.

    I am very annoyed that big chunks have been left out, seems deliberate...but of course I am not cynical :rolleyes:

    Thanks for address. Am doing this for my sister who has a learning disability. It was all charges on charges (she is on benefits).

    Not sure I understand your reasons for the missing info. I only want the charges / transactions for the months that are missing. Not asking for correspondence which might include a name. There are no names on any of the docs that have arrived. I fear the info commisioner is going to cause a lot of delays....might have to try another avenue.

    I have no fear of proceeding with the action. Just frustrated that we cannot move on any further until I the missing info is provided. I could guess the missing charges and total ammount in the hope that they will make me an offer but that is too risky, in case it does go to court - I will need precise info. I have no intention of taking an offer, so we are stuck in catch 22 :mad:

    Hi there Nick, I have to say that so far my dealings with HSBC in getting the statements, applying for the charges so far has been quite straight forward. Although they were quite quick to write back asking me for a break down, reason, and date of charges. I'm now awiting their reply. I also have requested statements from HSBC, HFC, BANK OF SCOTLAND, of which i've had correspondance from all and have not sent the £10 cheque to any of them.

    i sent cheque and letter off to abbey, and so far they have only sent me 3 months worth of statements and the 40 days is up on sunday.
    Can anyone help me out and tell me what i should do next and who i have to contact???
