I would take the 40 days from when they signed for the letter, you could send them a reminder letter 10 days before the 40 days are up reminding them an letting them know you will inforn the complaints commissioner if they do not comply with your SAR request.
Some companies such as barclaycard do this all the time. I think Im right in saying 40 days is 40 days not working days Im sure that will be corrected if Im wrong

Hi 4m Spinghirl, thank you both 4 your advice. We will be reporting the bank to the information commissioner and are thinking of sending 2nd letter for the statements we already have. We want to add to that letter that when we finally
receive our statements, we will be claiming for the years we didnt have statements for. We hope this works i have plenty of time on my hands and my day does not start at 9 and finish at 5 (housewives can letter write, telephone and complain til the cows come home) i love a good fight :mad:
Anyway, thanx again and i will keep you posted how things are progressing. This site is great and you know that old saying "Knowledge is Power" comes to mind.

Yes they are a tricky bank! My partner received the same letter as you have and he wrote straight back telling them that he would refer the matter to the ICO after the date the 40 days were up and when technically they had breached the terms of the data protection act. Since then he has received his statements in batches of 20 months at a time. 20 months one day, 20 months the next day etc and now after 40 months worth they've stopped sending them. We've written to the ICO but haven't heard anything back from them yet but basically Yorkshire Bank are stalling for time! :mad:0

Has anyone come across the situation when the bank have not sent the statements after 40days as per the template letter.

i sent my letter over 40 days ago requesting my bank statements over the last 6 years, they quickly took £10 out but still not had statements, also sent another letter saying that they still haven't sent statements,got aletter back saying statements have been ordered and that i should have them within the last 10days and if i don't receive them give them a call
well you guest it had to chase them up only to be told that they've not been ordered at all and that she had ordered them now and i should get them in the next day or two. no statements again so when i rang the number again all you get is a recorded message saying that there is a delay sending the statements. can someone please tell me what to do next as i want to no how much of my money they have.
getting really fed up of it all other people have received there statements (is the money they owe me that much that they're not sending statements)0 -
I sent a letter asking my local branch of HSBC for my six years of statements to get the charges refunded. I sent it at the same time as my Mum and we sent them seperately and recorded delivery with £10 cheques attached. They sent back the cheques a week later with a note saying 'Cheques not needed at this time'. Within a week my Mum had recieved her statements and she found out the banks don't actually owe her anything.
After 42 days, i rang my bank asking where my statements were and they had the nerve to say i hadn't sent them a letter. I asked them how they had sent back a cheque that they had never recieved, and also i had a signature from the recorded delivery reciept.
They then said it was 'one of those things' and i would have to wait another 40 days to get my statements.
Are they allowed to mess me around like that? What should i do next?
