I have asked and paid for my statements over 7 weeks ago and have still not recieved them, i have spoke to the bank on 5 occasions now asking for my statements, and all i am getting is there is a back log and it may take longer, Also i had another bank charge last week of £39 all because of £1 i rang and asked for them to tell my why it was so much and i was not going to pay till i had a breakdown of where the charges were going to and the manager was very rude and said i will be charged at the end of it so its tough when i said i could not pay it on that day specified and could it be put the day after she said it didnt matter they would take it out anyway and it would be paid when i have the money in, why cant they do that for the £1 i owed its stupid, i felt really small.
i know my charges to date are around £1500 over the past 6 years but i cant get my statements at all and they have taken the £5 fee to print them from my account.0 -

I sent my first letter (downloaded from this site) to Abbey National to find out how much they have charged me in fees over the last 6 years. Today I received a letter saying they are in the process of supplying the last 14 months transactions in the form of statements but they can't supply the years 2001-2005 as they have been microfiched and they are not available on their computer system. The bulk of my charges were during these years, (hardly any charges in the last 14 months). Are they acting legally? Is there anything I can do about this? or are they stalling for time? So I registered for internet banking to see if I could download all the appropriate statements, but they told me it will take about another 14 days! Think they got me by the goolies!!!0

Abbey just dont stop trying to deceive customers do they *sigh*.
You can write back and advise them (they DO already know) that microfiche is considered a relevant filing system for providing data under the Data Protection Act 1998 and you are entitled under the act to have this information represented to you in a clearly comprehensive form on paper. You are entitled to all of the data they hold on you by law and it is their responsibility as to how they present it, not yours. Advise them that they can provide copy statements if neccessary but that you will not be liable for any further charge other than the £10 statutory fee for such information. You can remind them that they now have however many days are left out of the original 40 allowed from the date of your letter to provide this information and you do not anticipate any further deliberate obstruction to your request.0 -
Thanks Twinkly. I'll try that. From 2001-2005, we had a hard time, mainly though the CSA, and most of our charges are from this time (I reckon probably around £3000). Over the last few years we have managed to stabilize our account so there are not many charges since this period. I think they have looked into this and are trying to reduce the amount they have to refund! Do you think our old statements will be available online, cos if they have microfiched them they shouldn't be available. I'll have to wait 14 days to find out.0

I dont actually know how far back Abbey accounts go online as I never bothered to set my account with up for that but someone else may read your posts and be able to advise. Your bank must provide the data. How they do it is their problem. Whether it costs them more than £10 to do so is their problem. That they must do it within 40 days is the law. They can provide you the data in any way they see fit, including:
-copies of your statement,
-a computer printout of charges,
-forming the charges using dwarfs arranged throughout the countryside and then taking you for a hot air balloon trip overhead to photograph the event,
-hiring monks (probably the ones with vows of poverty as they're cheaper) to transcribe from the microfiche into a gold-leaf manuscript and then delivering it via a religiousesque procession.

Have got as far as taking Abbey to court for just under £2000 of charges and interest plus costs now - they are defending the charges - should I take legal representative with me as they may be taking a stance - if setting a precedance for others want to make it right. Advice welcome. Also having to send off another £100 in court costs as over £1500 - changing courts to near where I live. Nonetheless will get to highlight in court some of their exorbitant interest charges one way as opposed to 0.1% when in credit and the fact that you need to be Einstein to work out how they penalise you for going overdrawn (with overdraft facility) when never actually or seemingly doing so on the printed statement -
Defence letter dated 23 March - another letter dated 19th March direct from Abbey in London asking for my account number, details of how calculated claim by date and amount, and details of how interest calculated - despite the fact that all info had been sent by Special delivery to Milton Keynes in Feb. - surely it shouldnt be up to me to supply another department info already sent - if they are asking for my account number what are they defending ?0 -
I wondered if anyone could help,i have applied to Lloyds TSB for details of charges over the last six years, they have got back to me after about 30days stating that they are prepeared to do this, but i notice in the template letter it states that they have forty days to respond to the request, does this mean doing as they already have or should i receive the statements within forty days?
Please someone let me know.
